Dear sir/madam
I had bought a Boss e 3300 mobile phone via telephone from Naaptol Shopping Pvt. Ltd. It was an advertisement in Newspaper. I had received the product on 25th March 2010 against which I made the full payment. Upon receiving I found out that the camera alignment of the mobile phone was wrong and also that the software was corrupted. I called up the customer care/ complaint dept. of Naaptol who in turn advised me to courier back the product to them. I did the same on 27th March 2010 & according to courier company's (Shree Maruti Courier) POD, the product has been delivered on 29th March 2010. Since 29th March 2010, I have been regularly calling up Naaptol's complaint division till date and every time I get the same reply from everyone that the system has not been updated yet. Its been 1 and half months now and still nothing has been done. I was promised and confirmed by Ms. Khatija Shaikh, refund of the total amount along with to and fro courier charges (Rs.3999 + Rs.200 + Rs.340) during one of my calls on 20th April. She said that it was a recorded call and that it is a confirmation from Naaptol that the refund will be effected within 15 days i.e. before 5th May 2010. I called up on 5th May only to find out that the system has still not been updated. I spoke with a supervisor again who confirmed me refund within 10 days i.e. on 14th May 2010. Today again I have called up and still the same story.
I am really fed up with this lousy attitude and working style of Naaptol Shopping Pvt. Ltd. I request you to advise me further course of action. Can a legal action be initiated? Kindly help me out of this as I have lost the money as well as the mobile phone and feeling cheated by Naaptol Shopping Pvt. Ltd.
