The Managing Committee members of my Society ie. "Bombay Middle Class Co-op Hsg Society Ltd" address plot no 275, Gope Niwas, Opp Sion Hospital Sion E, Mumbai 22. these members have been harassing us since 25-30 years now in some or other way.

Now since last 9 years they are imposing on me unreasonable amount in the name of Non occupancy / commercial charges of Rs.1000.00 per month and Hoarding charges of Rs.8000.00 per month,I am running a shop.

To claim this amount from me they have now approached Asst Registrar of Co-op societies Mr.Parab F/N ward, at malhotra house opp GPO mumbai 400001, opp CST railway station.

they have filed case against me under sec 101 of MCS act, I was called for 1st hearing on 16/4/09 and I duly visited on that day but the Asst Registrar was himself not present in his office and none of his staff was present and I was told by his superior authority's staff ie.District deputy Registrar that all are busy with elections and wont come.

Hence I gave my letter dt 16/4/09 to staff of Dist Deputy Registrar in same office on same 6th floor of malhotra house and I wrote that I visited but the Asst Registrar was not present and hence to grant me new date

I also sent copy of my letter 16/4/09 through courier to Asst Registrar of co-op societies F/N ward.

Then I recieve another letter from Asst Registrar Mr.Parab to attend before him for next date of 5/5/09 which is duly attended by my advocate Mr.Anant Khot and after this to my shock and disbelief I recieve "Exparte Recovery Order against me" from Mr.Parab saying that I dint appear on that said two dates of 16/4/09 and 5/5/09 hence exparte order is issued.

Now when I am approaching the higher authority ie.District deputy Registrar of Co-op societies at malhotra house, mumbai 1, I am told to deposit 50% of the claimed amount with society and then case will be lodged for hearing.

This is clearly a matter of trying to trap me , I believe the manaing committee members have bribed Mr.Parab (Asst Registrar of co-op socieities, F/N ward) and in above fashion are trying to harass me.

the managing committee members have been harasing me in some or other ways since years, sometimes creating problems regarding car parking, sometimes they make an issue about my pet dog, blocking entrance of my shop with there vehicles, intentionally passing resolutions to target me, etc etc, I am also suffering from heavy leakage in my flats but no solution to that also, they also harassed me while transfering flat in my name

These manaing committee members are

Now they are trying to claim from me an amount of Rs. 11 lacs in above fashion, though I have paid all legitimate dues that is maintenance, car parking, water charges, muncipal taxes, sinking fund, insurance. and by passing exparte order now above authority is asking me to pay 50% to society and then my appeal will be filed and taking into consideration
