    Default employee bond

    Presently I am employed with a private firm for the last 2 months. While
    joining the firm I had signed bond for Rs. 1,50,000/- saying that I will work
    for 3 years. The firm had not given me a copy of the bond/agreement. The firm
    has not spent any money for me for any type of training.

    Now I got a job with a reputed nationalised bank.

    I would like to know what would be the implication if i decided to join the
    bank. Whether the firm can taken any legal action against me ?. Does the legal
    action affect in any way with the bank job ?. Please let me know if such bonds
    (to retain employees) are legal in India.

    I request all of you to kelp me with your valuable advice.

    If any company don't spent any money on you then no body can do any thing of you...go without any problem because bond can only be liable when company provide any training to employee.     Iam going to sign a bond with my Employer ie job under atomic energy Govt. of India and it says I cannot appear in the any UPSC exam for the next four years of my service and in mean time I will loose the opportunity to appear in the upcoming examination and hence after bond period my upper age limit will get exceed therefore I request you to advise me whether can I appear in the UPSC exam even after sign the bond or is there any consequences on my career

    Dear Sir's
    I am working in a private bank and want to leave it.I have served here for around 1years and four months.They have made me sign a bond which states that if your notice period buy out is more than Rs 50000 you have to serve us a minimum period of one year and if your notice period is more than Rs50000 you have to serve for a period of Two years.Me bond amount is more than Rs50000/-.
    However at the time employment and issuance of offer letter i was not intimated in writing or verbally that if they purchase my notice period i have to sign a bond ,later on when i claimed reimbursements after four months they came out with a bond and i had no option but to sign the bond.
    My question is that since i was not informed about the bond at the time of emplyment the bond is illegal and would have served a bit extra in my prevoius bank and would have brought the notice period amount to less than Rs50000/-

    Hi All I had joined a small software firm over a 7 months back as PHP Developer after working with one small organisation for 19 months . I had signed a commitment bond for 2 year on plane print out offer letter not on bond paper. I getting many interview calls for better package. My guys are not going to hike my small salary till March 2012. I want to break this bond. Please help me guys. Is this kind of bonds are legal since i not signed on bond paper.

    1. Contractual Bond
    1.1 You will be required to attend special training and courses arranged by the company.You acknowledge that this is necessary for you to acquire the proper skills and expertise to carry out the duties of your employment, in particular, in respect of software development projects for the company, XYZ Technologies and its affiliates. In
    consideration, thereof, you hereby agree that notwithstanding anything to the contrary herein, you shall not terminate your employment with the company for a period of two
    (2) years with effect from the date of your joining XYZ Technologies. In the event that you terminate employment with the company prior to the expiry of the aforesaid
    two (2) years, you shall repay to the company immediately the sum equivalent to your monthly salary multiplied by the remaining number of months calculated as from the
    date of termination until the expiry of the aforesaid two-year period.

    2. Termination of Employment
    2.1 Company may at any time terminate this agreement by giving in writing to you 1 month notice during your probationary period or 2 months notice after confirmation or in lieu thereof a sum equal to the amount of salary which would have been accrued to you during the period of notice.

    2.2 You may at any time terminate this agreement after Contractual Bond period by giving in writing to company 1 month notice during your probationary period or 2 months
    notice after confirmation or in lieu thereof a sum equal to the amount of salary which would have been accrued to you during the period of notice.


    As mentioned in 1.1 they have not provided any training or course as I am an experienced Candidate And the technology used is open source.I want to break this bond for better opportunities. Please help me.

    Dear Sir,

    Past 17 Month i was working with a small IT company. I was in contract of 24 months.They made me to sign a bond in which many points we mentioned about discontinuation.

    After working hard at two of the major clients my company has terminated me stating misconduct, insubordinate, misbehavior, though this were not valid on my.
    My client side record is excellent, due to my performance they were making me Project leader and gave me the choice of YES or NO, i just said no because no one with the experience of 17 months becomes a Project leader, and they were forcing me because they had no one experienced person to place as a PL. I just said NO , as i was a choice given to me the very next day they handed me the termination letter stating misconduct, insubordinate, misbehavior.

    Past 17 months i was working on support project because they placed me, i never wanted to do that but by signing the bond they made us to dance as they want. They made the commitments of placing me into different role for which i was recruited and was committed. But they never did that.

    They even mentally harassed me, they have told me to suicide and many more thing.

    Finally handed me the termination letter stating i was wrong.

    And also asking me to settle the bond with amount 1,50,000 Rs and in turn they will only provide me my original certificates (All educational certs) which are with them, and will not provide me re-leaving and experience letters.

    Sir, Please suggest what should i do.

    Default Lawyer employment bond

    hi, i am an intellectual property professional. working in a company for last 4 months. i have signed a service level agreement and there is a two months notice period, it was also mentioned that if want to leave the company immediately without giving any notice then i have to repay two months salary to the company. i have not required any kind of training. i have only recevied monthly salary. recently i have got another good opportunity.

    whether my company can sue me for breaking the bond? is it legally viable in India?
