This is a discussion on i want to take my case of injustice by my previous employer within the Other Department forums, part of the Bad Response or Bribe category; my previous employer has not been signing my P.F withdrawal form,just because i didnot serve notice period for a month ...

    Default i want to take my case of injustice by my previous employer

    my previous employer has not been signing my P.F withdrawal form,just
    because i didnot serve notice period for a month when i resigned,even
    though they know that i had to resign that i am an outstation
    candidate and i had leave because my father was on deathbed.They are
    asking me to pay my 1 mnth salary then only will they sign it.My P.f
    is my right and nobody can stop me from having it.i dont understand
    how do i make a complaint for it and what procedures do i need to
    follow.can somebody guide me please.i'll ever so grateful.also cannot
    i file for a complaint online?

    sir i want consumer court to handle this for me. i am so troubled and harassed
    by them already that its traumatising to actually put across a point to them
    when they are just not willing to do anything about it.
    can you please guide me as to how can consumer court help me in this case.its a
    request.please bail me out of this situation.

    Hi,

    It's very sorry situation that you faced Amina. You are correct PF is our right.
    However when you join the company you also sign a contract with the company
    which states that you have to give a notice period of some time (in your case 1
    month) before you resign. This is for the company to make settlements and
    arrangements for your replacement.

    Considering your case to be genuine you can plead your company to waive off your
    notice period. I don't think there is any other way of claiming.

    1. It is true that Employee's PF is hight Absolute RIGHT, no one , I
    repeat no one can touch or get it, other than employee.
    2. Simultaneously Employer is Right in delaying clearaqnce, pending 1M
    Notice period Pay not being cleared by Employee. Employee just cannot break
    or Desert or put Employer into inconvenience or Blaim or Pressurize.
    3. But Employee surely can appeal / request and ask for their Pardon /
    and Waiver of 1M pay in lieu of Notice.
    4. Giving True and Genuine reasons, if found correct, 3rd is possible
    or one has to settle the respective dues.

    You just put one email in this matter to all the clients, business associates
    and other parties whoever deal with your previous employer. This will make
    significant impact and definitely few of those parties would revert back to your
    employer and ask about this. This will be very difficult situation for them to
    answer.

    You believe this will surely give you results.

    Your case does not qualify for consumer court. But u r on company roll untill
    your resignation is confirmed or they terminate your services.as suggested by
    C Court ask for your pay and we r here to assist u for future action also with
    regards

    Employees' Provident Fund organisation to settle the Provident Fund
    dues of his employees. He has to complete the prescribed application
    within 5 days of receipt [para72(5)] forms & hand over it to the
    member when he leaves the service. When a member finds difficult to
    get the form attested by the employer, he can get the attestation of
    any of the following officer & send to the Provident Fund office

    i got it signed by a bank branch manager and yet the file had to be snt to the
    previous employer for validation.wat do i do now?

    Hello Sir,

    Iam working in a company for the last two years in Bangalore. My job is related to IT telecom.
    We work in shifts alternatively . Weekends also work is there.
    Previously there were less employees in my company , but the company has recurited some more persons recently. Now i have the feeling that the company is trying to terminate me as they have taken more numbers.

    They are sending me emails stating that i was absent and this is the second instance without notice , previously it was not like that.
    Before some months they called up one employee for meeting ,and after that they informed that he has resigned from the company. (It seems they have forcebily has got the resignation letter from him") .

    I want advice from you people ,if the same thing happens to me , what should i do ?

    Should i sign the letter and go off.

    Alternatively i should ask them a notice period from the company side and a termination letter.
    (One of my friends informed me that if the company is terminating , than as per the indian rule they should pay us 3 months salary as compensation ---Is this true ?.)

    If they are trying to forcebily submit my resignation letter , Can i file a case against the company?

    Nothing has happened as of now . But as a preventive measure i want to know how can i play safely in my side.

    Exclamation Injustice by my Employer

    Hi,

    I need somebody to help me. I worked with one of the leading Telecom Retail Company in India. I am attaching the mail that I exchanged with the company CEO & HR - Head, for you to understand the scenerio:

    As discussed with you before leaving, the grounds on which
    I was asked to leave:

    1. I was given no prior information though as per the appointment
    letter says - The appointment can be terminated on either side by
    giving three months notice or salary (Basic) in lieu thereof... and
    there are 19 bullet points and I do not find any of the point that I
    could be choked for. Suddenly at 7.15 am on 24th of June 2009, I got a
    message from my AOM - Mr. Khan saying "Come to office and submit
    your resignation letter to me." Just couple of days prior to this SMS
    we had a cluster meeting where all the store mangers of Salhat Khan's
    cluster were present and out of 10 – 12 stores there were only two
    stores showing growth one was ITPL (47%) and my store (Airport Road
    8%) growth. This was the information shared publically in the cluster
    meeting before all the store managers. I was shocked to receive the
    message as shared with you, personally when I came to submit my
    resignation. I did not make this public in all the stores, because I
    did not want to create any negativity, though my brother and my family
    suggested me to approach this issue legally, not because they wanted
    me to continue working with this company, but just to seek justice. I
    know that my feedback can never change Karnataka in any ways because I
    have seen many like me just leave for no good / valid reason. I have
    no expectation in terms of loyalty, honesty, truthfulness, sincerity
    from people working with the company. Even if I write this mail to chairman's
    family, will not make any difference because Karnataka Regional Office
    Staff is unbeatable in terms of Ethics. No regrets I’m out and well
    settled.

    2. The reason I narrated this is because I’m in Chennai and I need to
    know when am I getting my Full and Final Settlement done, because I
    need to apply for leave at my current job to come there. Though I
    have less expectation from you guys to be fair to people, however,
    just to remind you when I left there were no gaps in terms of handsets
    and RCV. I was not given space and time to do handover, hence I’m not
    responsible for any gaps created by you guys prior or post. I would
    fight for what company owes me after all the injustice I have been
    through at the time of leaving. Though you suggested me to speak to
    Anil Pandey so that the rest of the people will not suffer like me and
    anticipating some favour in what was happening, I appreciate your time
    in listening to me the other day. You may or may not know it would
    have done no benefit.

    3. I want to remind you that I worked in the store till June 24th and
    I’m entitled for Nokia E63 and LG incentives. I received information
    that my store (Airport Road – 1583) has won the same and since I had
    put my sincere efforts I think I’m fair in asking that.

    I'm sending this mail to grieviences committee knowing for sure they
    can not help me.

    As promised that my F & F would be done in 45 days, I request you to
    send me the break up details of my F & F before that so that I would
    know what I need to do next.

    After number of reminder mails exchanged with the HR & CEO , I have got just Rs 6000/- creditted to my account and nothing else that I was entitled for. I am asking for the F & F statement , they are not providing. I was not given chance and opportunity to do handover and looks like they have put many things missing on me.
    I want to file a case against my employer. Do you think I should go to Media because, these guys are supposed to be so famous in the market , however exploit many like me. I can also make a commitee of many disappointed employee like me ..that they cheat.

    Please advise & help...

    Hi All,

    Kindly read it carefull.......
    I am working in a company and it has been 8 months now but till now i did not get my salary on time not even for one month in dec/09 I was paid for the month of sep/09 still two months salary is due whenever i talked to them regerding their answer is company is facing some financial crieses and all everything will get done soon all employes are facing the same problem..........now probably we can understand this but I am on a position in my company that I can see the personal expenditure of the owner if company is seriously facing such a big bad sitution how come they have money for their own big big big expenses and I am realising that company does not want to pay the salary what should we do in this situation....guys plz reply me on urgent basis as I am an outstation candidate and I am facing big problems I can not move on as I have seen people who are leaving are not getting their salary so am also afraid if i will leave this company they wont pay me ........
