I was working for a IT company in Bangalore for 2.5 years. I was the key resource during my stay not even one day non billable. When I joined the company notice period for resignation was one month. Later on when there was changes in management, overnight they made the notice period to 3 months with giving time to act upon.

Two months back I submitted resignation on personal ground. I requested HR to relieve me within 30 days. They accepted my resignation and my reporting manager confirmed orally that the notice period is waived off. HR relieved me before 30 days and on my last working day I completed the formality of getting NOC from all departments and surrendered company assets also. Company took the exit interview and issued me relieving letter and experience letter also and I got relieved formally. I also handed over my PF withdrawal forms to HR also

Surprisingly after few when I enquired about my final settlement, HR conveyed that my reporting manager has sent a mail to with held my final settlement as I am joining new company. After few days they send me a mail stating as my notice period is not waived off they are recovering 90,000 from my final settlement and in turn I need to pay back 8000 to company.

I send a mail stating HR that after my official relive it is unfair to hold my final settlement and recover 90000 against notice period. Also I conveyed them that if they had told me before relieving officially I would have served the complete notice period. When I further discussed telling that I would approach legally they threatened me saying they would give negative feed back to my new company and spoil my career.

I have escalated the same to higher ups in the organization with couple of mails and they are not replying to my mails.

I have all the communication exchanged through mail and all the letter related to my appointment and relieving.

What I want to know is can Consumer forum help me in getting back my hard earned money as I was working in shifts in night. If I approach legally will my previous company spoil my career during back ground check? If they do so what can I do. I do not want to spoil my career as well loose the hard earned money.

Please advise me how do I tackle this situation.
