Default Wrong Debit Entry in account & ICICI doesn't help

    Dear Sir/Madam,

I have Salary Saving Account with ICICI Bank, Colaba Branch. I have withdrawn Rs. 900/- from Kotak Mahindra Bank ATM (address- 13/14, Ashoka Shopping Centre, G.T Hospital Complex, L.T.Marg, Crawford Market, Mumbai - 400 001) on 22.10.2011 at 6.20pm. But there is an another transaction for withdrawal of the same amount and from the same ATM on 23.10.2011 at 5.00 am as per ICICI records. The same is not withdrawn by me on 23.10.2011. I have requested ICICI to investigate this matter. Also lodged complaint theu ICICI Customer Care and The complaint number is SR194735679. But they are not co-operating properly.

They are not giving any investigation report. They have not checked CCTV footage of the disputed ATM Machine. And saying that the withdrawal is done by Non-ICICI bank ATM Machine and we are not responsible for the same. The amount is small but they have damaged my faith in this matter. I have attached all the correspondence underneath mail for your reference.

Kindly help & register my complaint with you. Awaiting your reply.

    Dear Mr. Yevle,

We acknowledge receipt of your e-mail of November 16, 2011 and November 17, 2011 addressed to Mr. A. Palta regarding your Savings Bank Account XXXXXXXX3743.

We submit that based upon your complaint, bank has done the necessary investigation in this case. As per our findings, we state that the cash transactions are done from Non ICICI Bank ATM machine. However, we will not be able to provide our internal investigation report.

With reference to your query regarding the camera clippings, we are unable to retrieve the clippings as the transaction was done from Non ICICI Bank.

We would like to inform you that the camera clippings only captures images of the person withdrawing the cash, it doesn't capture the image of cash dispensed for security reasons.

In absence of the video clippings, the other documents like Electronic Journal.(EJ) will be taken into consideration.

We request you to meet this explanation with understanding and acceptance.

We assure you of our best of services at all times.

    Sincerely,

    Ashok Kumar Reddy

    Dear Mr. Ashok,

Please dont repeat the words again. You have not yet replied my below queries.

    * What kind of investigation done by your vigilance team?
    * Have they checked the CCTV footage of KOTAK MAHINDRA's ATM?
    * If it is NON-ICICI ATM transaction, which means you have no responsibility to invistigate the matter?
    * Your system does not make any mistakes.

I already told you that Police officer (Mr. Shinde - API) clearly advised that it is wrong debit entry & FIR is not required then why you are insisting for the same. I want to meet you personally then we will visit AZAD MAIDAN police station together. I will bear the cost of your pick up & drop from Bank. No issues on that.

And still you do not want to understand. Then I have to make big issue thru media also for smaller amount. I will give entire correspondence details to media. Let them investigate the matter and till the time I will process the complaint thru Consumer Court.

As all this information was in your possession when the disputed transaction occurred and it is the responsibility of the account holder to safeguard this information, the Bank is not liable to refund the amount of the disputed transactions. In view of the same, we regret our inability to refund the disputed transaction in this case.

We request you to lodge an FIR with the local police authorities against these disputed transactions.
