    Post Loss and misuse of stolen icici bank credit card

    I lost my ICICI Bank credit card (4477 4651 0282 7004) on 06.02.2010, which might have accidentally fallen off my pocket and fell into the hands of a miscreant. I came to know about the loss of my credit card when I was alerted by an sms on the evening of 07.02.2010 when a transaction of Rs 7380/- was done at a shop called La Mode Fashion in Delhi. Immediately I took action to block my credit card through ICICI bank customer care. But by that time already a transaction of Rs 17,604/- was carried out using my credit card in different shops in Delhi on 6th & 7th Feb’2010.

    I came to know from customer care there that there has been 14 transactions on 6th & 7th Feb’2010 amounting to Rs 17,604/-. I lodged a FIR in Indirapuram police station near my house as advised by bank and issued a letter to the bank alongwith copy of FIR to investigate the matter and refund the money. The investigation officer of the bank showed me the credit card slips of the concerned shops and there was absolutely no resemblance to my signature proving beyond doubt that all these transactions were done not authorized by me.

    Today I received a letter from ICICI Bank, ref. 020910/507130C dated 24.02.2010, absolving all responsibility of removing my grievances and fully holding me liable for loss of my credit card. It has also directed me to deposit my above payment immediately. On talking to customer care personnel, I have been told that bank cannot do anything to help recover the amount I have lost through fraudulent transactions by a miscreant.

    The bank has failed to give me following clarifications to my satisfaction :

    • My credit card has been printed with my photo ID and my signature on the backside of the credit card. If so, does not bank check the signatures on the receipt slip and that of mine before releasing the amount to the shops? What’s the mechanism of checking authenticity of transaction?
    • Secondly, when my photo ID is printed on my credit card, what’s the role of shop keeper in checking the identity of the person carrying the card?

    Judging by the ease with which the person kept on carrying transactions shop after shop with the stolen card during those two days, it appears that all these features of photo ID and signatures are farce and the bank is only interested in luring customer of his money. Had I not been alerted by sms message I would have been looted of my entire credit amount. The bank has washed its hands off by saying that keeping the credit card in safe custody is the responsibility of the card holder and that entire liability lies only with him irrespective of any mishap and bank has no role in safeguarding the interest of its customers in this regard.
    Please suggest the course of action I should take

    Default Stolen ICICI credit card and irresponsible ICICI bank

    Hello,

    This is regarding a theft on my ICICI bank credit card.
    I have opened my ICICI account in Pune and later moved to USA.
    Whenever I make any transactions through my credit card I used to repay in time
    (Never it was due) and I have never used the credit card internationally.

    My credit card was stolen on 22 May 2009 in San Francisco, USA.

    Incident: Someone broke into our car and stole my bag which has the credit card in it.
    All the transactions were made within an hour using all the available credit, which is a clear
    indication of a likely fraud. By the time I called the customer care and blocked the card it was too late
    and some international transactions over 65,000 were made when the credit limit is only 63,000.
    I have reported the ICICI bank regarding the theft and the COMPLAINT Number is SR107108663.
    I filed a police complaint with San Francisco police dept and the case number is 090-532-665.
    I have also emailed the scanned copies of all the required documents to ICICI bank customer care.

    To call ICICI customer care, every customer have to enter the credit card number and pin number.
    Then only it will give options to block the card. If the customer care contact number has block the card
    as direct option after telling name or date of birth or any other valid identity other than credit card number
    (when the credit card is stolen, how can anyone enter credit card number?), I would have been able to stop
    the fraud transactions. Also there is no direct number to reach the domestic customer care from USA
    to immediately block the card.How can the bank allow international transactions when there is no international
    customer support, especially to the domestic customers who travel abroad?

    ICICI bank's response: When I reported the incident to the ICICI customer care they told me that
    the case has been submitted to dispute department and it will take 45 days to investigate. I have been
    following up with the customer care since then, giving my contact information as I was not able to update
    my contacts through internet banking. I have waited for more than 45 days for them to get back, but
    received no communication on my email or phone number. After 45 days when I called the
    customer care they said that the dispute has been released in bank's favour and they have sent a letter and
    credit card to my former address, Pune even after repeatedly telling them that I am not in India and gave
    my USA address and phone number. Also, they have auto debited 3,540 and all the remaining balance
    as minimum amout due from my account without my knowledge.

    Settlement Issue: When asked for settlement the customer care replied that I have to pay half the amount
    of outstanding which is Rs. 75,000 and this is same as the actual fraud transactions. How can this be a settlement?
    I lost my job and it is next to impossible for me to pay such an amount.

    Whenever I ask the ICICI customer care about the card, they would give me one reply that" the investigation is done
    and it is in banks favour". The customer care personnels told me that they cannot explain when asked them to explain how the investigation proves me to be guilty and how can it be in the banks favour when it is obvious that the transactions were not made by me. They also told me that it is completely customer's responsibility when the card is stolen or lost. Is it not bank's responsibility to detect whether the transactions made were genuinely made by me or not (especially, When the transactions were made internationally in different stores, within in an hour, exceeding the limit) ?

    Can anyone please explain the questions below

    - Is it completely customer's responsibility when the card is stolen?
    - Why did the bank investigated if it is customer's responsibility?
    - Then why there is a dispute department?
    - What did the investigation department do?
    - When the investigation is carried out properly, how can they prove in the banks favour?
    - Is there any system to protect the credit card or the stolen/lost credit cards?

    Default lost card - Running for FIR

    I am having the simlar case here. Where with in 2 Hr the Conman has swiped around 50,000 from my account.

    Right now am running for FIR after police. Let's see what happens next. Will keep updating.
