Can we challenge ebay user policy when it violets or contradicts consumer's basic rights ?

This is in regard to the purchase of a camera from ebay on Dec 21,2010 from ebay seller Titlus Pvt. Ltd. I ordered a DSLR camera from this seller with the ebay id "titlusimited" . As seller was not accepting "paisa pay" payments due to some remittance issue. he suggested other methods (ie cheque, demand drafts and direct fund transfer) on listing page. I chose to pay through direct transfer and ordered a DSLR camera from him.
But after some time I got another alert mail from ebay which says that " titlus Pvt limited (ebay id "titluslimited") is no longer registered with the ebay india and i should not go ahead and make payment to the seller" which had already been done by the time i received this alert mail and now ebay asked me to contact my bank.
Now seller have stop responding and payment is credited to his account as confirmed by the bank. Though I have filed a police complaint against this so called "global company" Tiltuls P/L but This also
a negligence on ebay part .
I f they found this seller fraud or scamster:
A. Why did they wait for my order to suspend his account ?
B. Why did they let the seller list his items on "ebay india" and accepting my order successfully without paisapay and suggested that other method can be used for payment in their order confirmation email.
I have all the detail backed by doucmented proof which clearly show deficiency in there system
and services which cost me loss of hard earned money .
I can submit more detail but have no idea whether case can be filed online or I have to go to district consumer court for filing a case against ebay india
