I puchased a AKAI TV in march 2007 in response of
Indiatimes shopping advertisment. when TV stop working
for 3months I tried with company, service centre and
indiatimes nobody bother to solve my problem . Now i
am compled to lodge complaint in the court , according
i made a draft given below. kindly guide me is it ok?
or reqiure some amendment.

Application for the direction to replace AKAI makes
color TV set
I, Dr. Kaushal Kumar, resident of 17/2, Bhola Nath
Nagar (Behind Mother dairy booth), Shahdara, and Delhi
110032 do hereby solemnly affirm that:
1. That I have purchased an AKAI Color TV + DVD
player vide advertisement dated 25/03/2007 in Times
of India readers offers (www.
Shopping.indiatimes.com) on 6 EMI through ICICI credit
card these products have a 7 years warranty.

2. That on 9/05/2007 this TV set stop working
suddenly and I lodge a complaint with AKAI customer
care centre having complaint no. DWA 7E 09014. They
assured me to visit us within 48 hours. Since no one
came even after 3 days, repeated complaints were made
to Customer care AKAI and Pearl Electronics
(authorized service centre for AKAI TV) but with out
any result. So repeated complaints were made.
3. After Ist complaint and till date two times the
TV chasis has been taken away by the service centre
mechanic & the same could not be repaired till now.

09014 was lodged with India times customer service
centre. It was assured that complaint will be attended
within 48hrs.
11/05/2007 Mr Veenet visited my house and took away
the TV chasis for installation of software as it was
not working.
Between 11/05/2007 & 30/5/2007 When it was not
installed several reminders was given on phone no.
65296240 to Mr.Kapil, 9810884877 to Mr. Virender and
on 9213188191 to Mr. Surender (Mechanics and incharge
of pearl electronics, the service centre for AKAI TV
but every body was befooling me.
31/05/2007 Again complaint was lodge to customer care
with complaint no.400AA07E31467 which was attended by
Mr. Avedesh
01/06/2007 Reminder was given to Mr Manoj Yadav ,
Manager service centre on phone no. 9313018283
02/06/2007 Software & Chasis was installed in TV after
a gap of 24 days but not working properly and mechanic
assured me that same would be done within 2 days.
04/06/2007 When not repaired, again the complaint was
lodged with Mr Krishan Pal incharge service centre on
phone no. 65854854 & he assured me that same will be
done within a weeks time.
10/06/2007 Again a complaint was lodge with customer
care complaint no. 400AA07F10191
16/06/2007 Mechanic from service centre visited my
house but could not remove the fault and told my son
that he will come some time later but did not turn up
02/07/2007 Again a complaint was lodged with customer
care complaint no. 400AA07G02244
04/07/2007 Upon contacting Mr Krishan Pal Incahrge
service centre on phone no. 65854854 he advised me to
contact Mr. Bal Ganesh (In-charge East Delhi service
Centre) on phone no.9313018286, accordingly I
contacted him and explained my TV problem
06/07/2007 Mr. Lokesh (Phone no. 9350305428), mechanic
of the company came to my house and took away the
chasis of TV (under receipt enclosed) to service
centre for repair. He assured us that same would be
returned by 10/07/2007
14 /07/2007 After daily reminder to him and his
in-charge TV chasis could be installed on 14/07/2007
but it did not worked again.
Now the company mechanic left my house without my
signature on the complaint receipt.
Even after two month of complaint and more than 100
phone calls to different company officials, presently
my TV set in not working at all and is dead.
21/07/07 I sent a fax letter explaining the complete
situation and to request for the change of TV
30/07/2007 Upon not getting any response, Again the
letter was sent by registered post to company office
address and at the Registered office address.
Letter posted at the Reg. Office address was returned
back to me with the remark no such office at this
address
Between 30/07/2007 and 10/8/2007 Talked on phone Mr.
Sudhir (9310556310), Mr. Aswani Sharma (9971394631)
senior marketing officer at company office address,
Mr. Bal Ganesh ( 9313018286) , Incharge AKAI service
centre East Delhi . All these officers refuse to solve
the problem and tolled me to approach consumer court
or wherever I like.
4. That Now I have no faith in the company , service
centre of the company and customer care of AKAI TV as
I have been harassed & tortured for more than three
months and request to do justice for me. I pray the
following:

In view of the above I, most respectfully pray that:
1. Instruct the company to replace the TV set with new
one as present TV set could not be made functional
even after more than three months.
2. I feel mentally harassed because of falls
assurances given by the companys service centre staff
and officers. Further during this period I made more
than 100 phone calls and waited for company staff. So
this is a case of lack in service, accordingly I may
be compensated Rs. 5000/- or as the court may deemed
fit for it.
