I placed an order for a printer "Canon Pixma Mp450 All In One Inkjet Printer" on Indiatimes.com shopping page on 2nd Feb 2010. The price of the printer on the online shopping site was Rs. 3554/- and the order number given to me was 112186021. I got a confirmation of the order and my account was debited this amount. The "seller" was mentioned as "Smart Deal" on the shopping page.

I did not receive the printer for over 3 weeks in spite of repeated remiders to Indiatimes. And then suddely, in the last week of Feb, I got a call from Indiatimes saying that the order would be cancelled becaue the vendor was unable to deliver the item! However, when I checked the Indiatimes shopping website, I could see the same item but this time at a price of close to Rs. 9000/- by the same seller!

So while I was being denied delivery of the printer at the price committed to me (and taken from me) giving a reason that the printer was not available with the vendor, the vendor was offering the same printer on the website for double the price!!!

The order confirmation I had received had complete details ofthe order including the price - my complaint is that there has been a breach of contract by Indiatimes by accepting payment for promised delivery of the printer which they have not honoured.

Can I submit a complaint to the consumer court on these grounds and if yes, please let me know the procedure?
