    Unhappy processor and motherboard problem

    Sir,
    I had purchased an assembled personal computer from an authorised dealer in Kalyan (Dist Thane - near Mumbai) on 19th october 2006. Since the time i have bought the product i have been facing problem with the working of the system. The purpose for the purchase of the same was to be able to use graphic softwares (Autocad, corel draw, Adobe photoshop, 3D studio max). But the computer was found to be inefficient since the very beginning and though it was of good configuration it would not run these softwares properly. Everytime the complaint was made to the dealer he would, after a number calls give service but that too only to format the computer and give it back again. This did not resolve the issue as i was still unable to work on these softwares. In the month of november 2008 after a lot of persuasion he agreed to replace my mother board and processor. He kept my computer with him for more than one and a half month and told me that the replacement has been done. As the problem still was not resolved and i contacted him again and after a heated argument he agreed that the processor and mother board were not replaced but repaired by their engineer even though the product was in warranty period which means that the dealer himself has tampered with the product in its warranty period, when it could have been replaced easily. Verbal acceptance of his mistake was done only in the last week of february. Now he has replaced my computer's AMD processor with that of intel for which he is giving me no warranty at all. I have asked him to give my processor back as i can then directly contact them and sort this matter but the dealer is refusing to give it back to me.
    Below are the details of the dealer and the products i have bought from him with their warranty period.

    Dealer:

    Smart System (now Systems & Solutions )
    14, Archies CHS, Oak Baug, New Station Road, Kalyan (west)

    description of goods:
    1. Processor AMD Athlon 3200 64 bit (3 yr warranty)
    2. Mother board Gigabyte K8-51GMF9 939 PIN (3 yr warranty)

    All these problems have been persisting for 2.5 years and we are tired of the dealers false promises and service for the product. The replacements and rectifications that could have been done in the first year of their service only has been delayed till now and i have not received a permanent solution. To add to this we have been making him minimum 5 calls a day and have been visiting him ever since we bought the machine.

    Can i get refund for the machine provided by him as i dont want to keep this faulty piece with me. The UPS, LCD monitor, Printer etc that we have bought from him also are causing problem to us since the time we bought it.

    Kindly let me know what can be done about the same.

    I have the bill with all the details in it.
    The warranty of the mother board and processor will get over in october 2009.

    Have you paid the AMC to the dealer of the current year ?
    Have you all the job sheets ?
    What are terms mentioned on the bill ?

    Default Bills and AMC

    Dear Sir,
    As this problem continued ever since we had bought the machine and he had not been able o fix the problem, i did not sign him up for the AMC. I only requested him to solve this problem so that i could carry on with my work and had decided to sign some other person for the AMC as his engineers never could provide satisfactory results. tha last time i paid for his service was on 26 Sept'08 and i have the bill for it too.But before this also i have paid him 3- 4 times for the service but i do not have the bill for it. Service for the machine to be provided by him was only for one year but he had told us that if there is any problem with the parts in the warranty period he would be getting it repaired or replaced as they had bought these parts from a different place altogether. As such he has not mentioned any terms and conditions in writing, except for mentioning of the warranty period on the bill itself.
    May i know if there is something i can do about it as i have to continuously work on the softwares and the dealer keeps my computer with him for weeks to get it repaired and still doesnt manage to do it. His engineers do not solve the probelms in first attempt and when i complain about it they say that they will send him again but never actually send him till one week and that too after a no. of calls. I am losing out on a lot of money and work as i am a freelancer.

    Sir,

    I have not continued with the AMC with the dealer as his services were unsatisfactory. He was to provide us the service only for the first year. But as the system had never actually worked properly with the softwares we kept on going back to the dealer. He also said that as long as the products are under warranty he would take care and deal with the company and get it repaired or replaced. I have not paid him everytime as the problem was never solved but the system was only formatted and returned. He also made us buy the Anti-virus saying that it was virus that was causing trouble. But the problem still persists. I even have the bill for the Anti-virus and the service charge charged on 26th Sept 2008. We generally did not pay him as the same problem was always there. The bill has only the warranty mentioned by the dealer himself. There are no Terms and Conditions in written with us. The LCD monitor was repaired twice by the company, the UPS has been repaired once and i have the bill for them (By the company). We are using our own power cords as the new ones had loose connections.

    I am an interior designer and work as a freelancer as well. I need my computer everyday with all the softwares but this dealer takes the CPU for repairing and doesn't return for weeks together. As a result, i am suffering a lot monetorily as well. And since the past 2.5 years i have been making calls to him frantically but he provides service only at his convenience. He also accepted that the problem was not solved and so he did not charge me for the service of the same. Is there something i can do about it because the piece has been faulty ever since i bought it and i dont trust this dealer to provide me with good replacement option as well.
