    Default Postpaid service not activated

    Dear Support,
    See i have already paid the sum of Rs 600 for the plan for montly rental
    199 with call charge as below
    any airtel local national mobile 50ps
    any other mobile or std 60/80ps (i dont remember 60 or 80 ps)
    As per the call given to me, they said that i was lucky customer for which i
    am getting above facility for which they took my address and one of the
    agent name V. J. Bhopi came to my place and i handed the money and other
    documents to him he said that within 24hrs my service will be activated.
    In regards of the plan i got a call from number 9967496059 and the time was
    11:53 A.M on 26th November 2009. I am trying the number from which i got a
    call but it is switched off.
    Also i have attached a recorded file of my conversation with the person from
    airtel to this mail.
    Even i have the carbon copy of the form which a filled during the
    subscription.
    PLEASE LET ME KNOW ABOUT THE ISSUE or ELSE I THINK I HAVE TO GO IN CONSUMER
    COURT.

    Hello Sir,
    I have taken 2 connections from Airtel and i am forged by airtel executives.
    Please help
    my post no are:

    I am a victim of one of the authorized Airtel executive who has given me
    750/- plan with below details in attachment.

    Now when i received my bill, I am charged

    I lodged a complaint to customer care executive with complaint no - 29430042
    and nothing has been done yet. The complaint was supposed to be dealt by
    24thNov 09.

    The matter has to be seriously dealt with as this is a forgery case. I am
    continously writing emails to cusomer service people and other then sharing
    request no and ref no no action and resolution has been done yet.

    Please help me

    Default Complaint Against Airtel

    Dear Sir,
    I am an Airtel Customer and my telephone number is 9871555082. I have
    registered for "Do Not Disturb" service (since 22/10/2007, Registration
    No. 1000475941) but I am still getting promotional calls.

    I have already raised a complaint with my service provider for the same
    (Complaint No. 1124262284).

    Today I received a call from an Airtel executive to talk about the above
    mentioned complaint number. As per there record this complaint pertains
    to some call drop problem and not about promotional calls.

    When I requested the executive to connect the call to his Supervisor or
    Manager he did not connect the call and said that there is no Supervisor
    or Manager available on the floor. When I insisted, he abruptly
    disconnected the call. As a customer it is my prerogative to talk to
    some one in authority and get my problem solved. It is very frustrating
    and humiliating to go through such a disgusting experience.

    PLEASE HELP!

    These are number of deduction which is
    wrong from your side as per my knowledge,plz give me confirmation within
    short time period that is 24 hour becaues i am in trouble and mentally
    harassed due to these problem and asking for solution since approx 3
    months.if you and your authority is unable to provide me solution within 24
    hour i will move towards honorable consumer court for these harassment
    compensation.

    Sir,
    Myself Sandip Kumar Sharma,i m using one prepaid mobile having no.9996312751.From
    last three days while calling first time in morning there was an alert message every
    time that "your grace period is shortly going to be lapsed".when I checked the
    validity through *123#,it was upto 2021 but through *121# validity was showing upto
    06/12/2009.I was confused and talked to customer care five times regrding this,every
    time i was suggested to get its validity increased because 06/12/2009 was the end
    date while validity upto 2021 was due to "server error".So I decided to get it
    done.Also at the recharge centre I clarified one more time and got an Rc of Rs/-91
    for lifetime validity.This lapsed special tariff scheme for STD call reduction which
    I had got 10 days back by paying about 60/-.
    Again when I checked the validity through *123# it was showing 27/09/2021,it was
    upto 30/08/2012 through *121#,totally confusing.then i again contacted customercare
    and he told that I should have asked them before recharging.when i asked them who is
    the senior authority whom I can lodge a complaint then he disconnected my phone by
    saying that his senior will talk to me later.
    At last a message from 121 came with request reference number-1205381595,and there
    after no responce from them.
    Please take necessary action against them for misguiding their customers.

    mobile office with 395 Rs recharge but last 01-12-2009 i am connect my
    mobile on my computer my balance was automatically detected. i will tell
    this problem many time to customer care but they have no any solution & cut
    the phone.

    SRI.K.T.SIDHIQ : PRESIDENT



    Complainant Sri.Ashraf is a serving soldier in the army. He is a subscriber of mobile phone with No.9746032446/- provided by the opposite parties, a Cellular phone service provider. The grievance of Sri.Ashraf is that the opposite parties wrongly debited a sum of Rs.106/- from credit. Though he spent much time and efforts to know the reason for this illegal debiting of Rs.106/-, none of the officers of the cellular mobile provider or their dealers give him any explanation. Hence ,this complaint praying for a compensation of Rs. 30,000/- and also a direction to the cellular mobile telecom service provider not to repeat this kind of defective service.



    2. Ist Opposite party, Bharat Air Tel Ltd. appeared and filed version. According to them, the debiting of Rs.106/- from the credit of the complainant was owing to a technical defect of the system. When this fact came to their knowledge they tried their level best to remove the grievances of the complainant by way of compensating him with the service of the company for which the complainant do not agree. The complainant claimed a huge amount of Rs.30,000/- and he was not prepared settle the matter for a lesser amount and hence the amicable settlement failed. Further the amount of Rs.106/- was already credited to the account of the complainant ‘s mobile phone. The complainant took advantage of the cause of debited amount to his unlawful gain by filing this complaint. Hence the complaint is liable to be dismissed.



    Subsequently, Ist opposite party challenged the maintainability of the complaint by filing an additional version in the light of the decision of the Hon’ble Supreme Court in the civil appeal No.7687/2004 in the matter of General Manager Telecom vs. M Krishnan and another.



    3. The wife of the complainant Smt.Mumtaz as the authorized representative of the complainant adduced evidence on behalf of the complainant. On the side of opposite party N o.1 Ext.B1 marked. Both sides heard and document perused.



    4. Now the points arises for consideration are:



    1. Whether the complaint is maintainable before the Forum?

    2. Whether there is any deficiency in service on the part of the opposite parties?

    3. What are the reliefs to be ordered?



    5. Point No.1: Relying on the decision of the Hon”ble Apex court in the case of General Manager Telecom vs. Krishnan decided in Civil Appeal No.7687/04 the learned counsel for Ist opposite party Sri Srikanta shetty vehemently argued that the complainant is not maintainable before the Forum and it shall be referred to an arbitrator appointed in terms of 7(B) if the Indian Telegraph Act 1885. We disagree with his submissions. Firstly, the said provision 7 (B) of the Indian Telegraph Act is not applicable to private telecom service providers like opposite party since as per 7(B) of the Act, the Central Govt. has to appoint an arbitrator to settle the dispute between an individual consumer and a private telecom service provider. We don’t think that in this era of liberalization the Central government had any business in the settlement of disputes between a private telecom service provider and an individual consumer and therefore it is clear that the said provision of Telegraph Act is not applicable to private telecom service providers. Secondly, the application of relevant provisions of TRAI Act

    The TRAI Act is a special act enacted in 1997 and amended in 2000 to provide for the establishment of the TRAI( Telecom Regulatory Authority of India) and TDSAT ( Telecom Disputes Settlement Appellate Tribunal) to regulate the telecommunication services, adjudicate the disputes, dispose of appeals and to protect the interests of service providers and CONSUMERS of the telecom sector. etc…

    6. Therefore, when compared to consumer Protection Act and Indian Telegraph Act TRAI Act is a special act enacted to protect the interests of service providers as well as the consumers of Telecom sector. Sec.11 of the Act deals with the functions of TRAI and Sec.12 describes it’s powers to call for information, conduct investigations, etc Sec.14, deals with the establishment of TDSAT ( Telecom Disputes Settlement Appellate Tribunal) to adjudicate any dispute --

    i.) between a licensor and licensee,

    ii). between 2 or more service providers

    iii). between a service provider and a group of consumers



    The proviso clause of this sections further says that nothing in the above clause shall apply in respect of matters relating to –

    (A) the monopolistic trade practice , restrictive trade practice and unfair trade practice which are subject to the jurisdiction of the Monopolies and Restrictive Trade Practices Commission established under sub-section (1) of Sec.5 of the Monopolies and Restrictive Trade Practices Act ,1969(54 of 1969).:

    (B) the complaint of an individual consumer maintainable before a Consumer Disputes Redressal forum, and Consumer Disputes Redressal Commission established under section 9 of the C.P.Act,1986(68 of 1986);

    (C) the dispute between telegraph authority and any other person referred to in sub-section (1) of Section 7)B of the Indian Telegraph Act, 1885(13 of 1885)



    7.. So after the constitution of TDSAT all the disputes relating to the telecom sector shall be adjudicated before the TDSAT including the dispute between a telecom service provider and a GROUP OF CONSUMERS. But as per the proviso clause in Sec.14 TRAI recognizes the jurisdiction of the Consumer Fora constituted under Sec.9 the Consumer Protection Act with respect to the disputes between an individual consumer and a telecom service provider. Therefore, we hold that Consumer Fora constituted under the Consumer Protection Act has got jurisdiction to try the matters filed by individual consumers against telecom service providers. Therefore, this point is found against the contention of the Ist opposite party.



    8. Points Nos 2&3: The specific case of the complainant is that inspite of his repeated contact with the various authorities of Ist opposite party, his grievance was neither redressed nor they could give any prompt reply for the wrong debit of the amount from his credit. Hence he filed the complaint. Further he is aiming the public interest of those who are exploited by the mobile phone service provider in the manner in which he is exploited.

    The Ist opposite party has admitted the wrongful debit of Rs.106/- from the credit of his mobile phone. But according to them, it was happened due to a technical default. Where was the technical defect? What was the technical default? How it occurred ? How long it continued? How many customers of the Ist opposite party are affected by this technical default? How much money was wrongfully debited due to this default? What are the steps taken by them to credit the wrongful debits to its customers?, What are the corrective measures taken to prevent the recurrence of this defect ? etc were unexplained by Ist opposite party. It is pertinent to note that even the amount of Rs.106/- wrongfully debited from the account of the complainant was credited only very long after filing this complaint, inspite of repeated contacts with the various service agencies of Ist opposite party before filing the complaint. Hence the contention of Ist opposite party that they tried settle the matter amicably but the complainant claimed a considerably big amount of Rs.30,000/- by way of compensation is not appears to be true.

    9. We appreciate the complainant Sri.Ashraf, an army man fighting for our nation, has spent much time and efforts to fight against the injustice suffered by him without considering the monetary loss suffered.

    10. The Hon’ble Supreme Court in the case of Charan Singh vs. Healing Touch Hospital has observed as follows:

    While quantifying the damages consumer forums are required to make an attempt to serve ends of justice so that compensation is awarded in an established case, which not only serves the purpose of recompensing the individual but which also at the same time, aims to bring about a qualitative change in the attitude of the service provider……”

    We find that this is a fit case in which some excess compensation has to be awarded to make a qualitative change in the minds of opposite party. Hence the dictum laid down by the Hon’ble Supreme Court can be applied in this matter to fix the compensation.

    In the result, complaint is allowed in part and Ist opposite party M/s Bharat Air Tel Ltd is directed to pay a compensation of Rs. 7,500/- along with a cost of Rs.2000/-to the complainant. Time for compliance is limited to 30 days from the date of receipt of copy of the order. Failing which the said compensation of Rs.7500/- will carry interest @12% per annum from the date of complaint till payment.

    Default Outgoing connection was barred.

    Hi,

    I have been using Airtel connection for the past 8 months. Today morning, I received an SMS, which read -
    "Dear customer, we are unable to verify ur address, listed with us. Since verification is mandatory as per Govt. rules, your calls will be barred today."
    And, in fact, all my outgoing calls were barred.

    I am pretty much upset with this issue because ---
    a) I had verified my address ~8 month ago while taking the phone.
    b) There was no intimation from Bharati Airtel, regarding the reverification process.

    I had called the Airtel Customer Care, and they told me that the re-verification process was mandatory. They also claimed that they had called me 3 times, and I had not replied. I am not arguing that their claim is false, but it s quite possible that a person may not receive the calls, since he might be busy at that time. Isn't it quite obvious to send a letter to the address or at least, an SMS to verify the address?

    I would like to know if there is any clause in the Govt. rules which specifies the process of this address verification, and if there is any way for customer grievance redressal.

    They have also told me that I need to re-submit the address verification within 24 hours !!!!

    I am not quite sure if this issue can be addressed in a court and I would like to persue this, because it is extremely irritating when you suddenly wake up in the morning and out of the blue, you see your pre-paid connection is out of order for no apparent reason.

    Respected Sir,

    I am RANJITH MARIADASAN. I have been using my Airtel Mobile No.9840020008 for last 9 years. It was a previously postpaid number and later on I changed it to prepaid number. I am from Chennai and have purchased the said number from Chennai itself. I have been regularly using this particular number for running my business and it has been circulated to most of my clients and friends. During the last month or so, my mobile instrument was out of order, and due to which I could not use the said number. But on approaching Airtel Customer Care Office at Chennai last week, it was told to me that you cannot retain the same number and they didn't seem to bother to provide me a proper and legible reason for the same. As I have heard of good quality of after-sales-service of your company, I fail to understand as to why I cannot retain the said number.

    I would certainly appreciate if I get a feedback or a proper response from your end. Since nowadays, I am put up in Mumbai, my present contact number is 9892873979 and my email id is models009@gmail.com.

    Angry airtel FAILS at e-recharge : No balance update till now

    Dear sir/madam
    I'd recharged my 'airtel' & 'bsnl' mobiles with 'ICICI-Prepaid Mobile Recharge service' on 12/11/2010.I'd got 'successfully recharged' massages on both mobiles.But after waiting for a long time still airtel mobile balance is not updated.I'd contact 'airtel customer care' on that issue.but they've no satisfactory answer.They asked me to contact bank so I did.
