I bought this Blackberry Curve 8520 in august from Lucknow. In December it stopped working and got hanged, network went out intermittently and the camera was hazy. I live in Dehradun presently so i went to the blackberry appointed 'Redington India Center'. The took more time than they had initially claimed to and i got a mail a few days later claiming that my phone was irreparable due to 'customer abuse' to the SIM Tray. My blackberry never had a fall, I even kept it in the blackberry original hardshell cover. The phone has never been opened and SIM Tray cannot get damaged without that.

They are denying me a warranty and asking for Rs 5860, whereas I couldn't see anything in the warranty statement saying that there was any such disqualifying critera.

How should I proceed with suing them in consumer court.
