Hi,

I have purchased a mobile hand set online through ebay.co.in, offerings presented by web site, were as below,
1. Brand New HTC Touch Diamond 4GB with National Warranty & Bill.
2. Offered Price was INR 20500
3. Free Home Delivery was also offered.
4. Intrest free installments of 6 or 12 months were available.
5. After payment, Item will be dispatched within 07 days and after dispatch, Item will be delivered within 10 days to my registered address.

Actual date of purchasing was 02-Sep-2009. I choosed payment mode of 06 intrest free installments. Payment made by using Paisa Pay facility online.
Afterwards, I received a message from ebay that Item is dipatched to my registered address on 09-Sep-2009.
My family received Item delivery on 21-Sep-2009 as I was transferred by my company to Chennai. After 15 days, during my visit to home on 07-Oct-2009, I checked the Item delivered to my address by ebay.
My observations are as under,
1. Packing box was slightly cracked (This was assumed to be cracked during transit period) and not taken as serious complaint.
2. Bill enclosed with packing was not as per specified details (i.e. billed amount mentioned was INR 4999, Item serial number and details were not mentioned in bill, it was mentioned in bill that "This item is not for sale and do not poccess any commercial value").
3. After scrolling through mobile software, it was observed that hand set was already used for approximate time of 169 Hr 26 Min 42 Sec for Incoming calls and 43 Hr 30 Min 44 Sec for outgoing calls.
4. After more investigations, an image photograph of an unknown couple was found in the memory of hand set.

Actions Taken;
1. Immediately, I contacted ebay customer care for help.
2. After that contacted seller as directed by ebay customer care representative.
3. Seller excepted to send correct bill and explained frieght saving as the reason of fake bill previously delivered with Item. For complaint of old/used mobile set delivery, seller did not accepted my allegations.
4. After listening to my statements, seller advised me to send mobile hand set back to seller's address without any consent of ebay.
5. I requested to ebay to get involved in my problem to help me and to protect me from any robery by using all tools n options in ebay web site.
6. After few months ebay sent me a mail to confirm me that an investigation commitee is formed to handel my case. They asked me some details and proofs of payments and purchasing but never spoken to me.
7. After few more months, I received a new message from ebay, that my request is rejected by investigation commitee.

Afterwards, till date, I am sending contineous mails with some time intervals, to ebay requesting refund of my payments. But not any response received till date.

As on date today, all my payment installments are paid to ebay through Paisa Pay online debited from my credit card account. But, still I have not used the mobile hand set and keeping safely with me to keep the proofs of my allegations.
Plz help me or guide me accordingly.
