The complainant’s case is as follows: The complainant purchased an Automatic Sliding Door on 28.10.2004. At the time of purchase the amount of the door demanded was Rs.25,225/-. But by various occasions they received Rs.33,606/- in total. But this door did not work continuously at least for a week. When the complainant reported the respondent came after a few days and make it repaired. Finally when the door again became defective the staff of the respondent came and they had taken away the parts of the door for the purpose of repair. But it did not return back. Subsequently on 9.3.2007 the respondent issued a bill for an amount of Rs.14,595/- and intimated that they will not fit the door after the payment of this amount. The product showed defect continuously and became useless and every time of repair the respondent received charges also. The respondent issued a low quality product showed unfair trade practice. The complainant can’t keep his building neatly as the door was not working and it affected badly his business and suffered loss. Hence the complaint.
2. The respondent called absent and set exparte.
3. To prove the case of the complainant he had filed an affidavit and the documents produced are marked as Ext. P1 to P6.
4. According to the complainant, he purchased an automatic sliding door from the respondent for an amount of Rs.25,225/-. But by various occasions the respondent received from the complainant an amount of Rs.33,608/-. Besides this the product showed complaints within a short while and the respondent repaired it and received the repair charges. Finally when the door again showed complaint, the staff of the respondent came and taken away the parts of the door for repair. Till this time they did not return it. Subsequently on 9.3.07 they issued a bill for Rs.14,595/- and informed that they are ready to fit the door after the payment of this amount. So the product delivered by the respondent is an inferior quality one and there is deficiency in service on the part of respondent and also unfair trade practice.

In the result, the complaint is allowed and the respondent is directed to return Rs.33,606/- (Rupees thirty three thousand six hundred and six only) by taking the remaining parts and further directed to pay Rs.2500/- (Rupees two thousand and five hundred only) as compensation and Rs.500/- (Rupees five hundred only) as costs to the litigation within two months.
