Judgment against Yashaswini in Venugopalakrishna Bhagavatha case.
Venugopalakrishna Bhagavath is a poor farmer who lives on a meager income earned by doing priesthood performing pooja to God and agriculture. He had hernia and also Yashaswini Insurance from Panaje Co-Operative Society. He underwent hernia surgery at Dhanvanthari Hospital, Puttur. Had uneventful recovery. Sent the claim bills to the C. E. O of Yashaswini who very promptly replied that under the existing rules framed by his superiors he could no way concede to his request of sanctioning the claim as the claimant had erred by taking treatment in a non-networked hospital and the dual purpose of promulgating Yashaswini scheme was make sure that (i) hospitals which come under the network get good number of patients and (ii) Farmers get subsidized and highly substandard treatment. Irked by this letter, Venugopalakrishna Bhagavat lost no time before approaching the leading lawyer of the town Mr. Sanjay D. for solution. Mr. Sanjay gladly accepted Bhagavat's proposal to bring to book the unscrupulous elements pervading various departments and their non farmer friendly hostile attitude.
Yashaswini was represented in the court by Mr. Thimmayya Advocate who offered standard resistance and a defence for the sake of defence without much credence. Panaje Bank was represented initially by Mr. Shambhu Bhat and then by Mr. K. G. Rajesh both well known attorneys who argued vehemently to keep the society's interest protected at the cost of Yashaswini's interest. Midway through the trial, Mr. Thimmayya came up with another futile gesture of trying to bring the Hospital into the controversy by putting an impleading application. Mrs. Asha Shetty the president of the Forum was unimpressed. She summarily turned down the IA saying that hospital is no party to this duel and Yashaswini must own the onus on its own. Yashaswini bit the dust. Please go through the entire text of the District Forum Judgment.----------> Venugopalakrishna Bhagavath DF Judgment.zip There is a great deal to learn.
