Shivaram Bhat, Resident of Sullia Taluk, D. K. District, member of Chokkady Society had Yashaswini Insurance. He developed arterial insufficiency to his leg and had to undergo peripheral arterial angiogram and angioplasty procedure at Bhagwan Mahaveer Jain Hospital, Bangalore. His bills were sent to Yashaswini by his wife who was the survivor of Shivaram Bhat. Yashaswini promptly refused. Society Secretary N. Vasudeva Gowda did not co-operate in getting the claim amount of Rs. 1,53,114/- released from Yashaswini.
Saraswathi S. Bhat moved the Consumer Court in Mangalore. After thorough enquiry the Forum granted the full amount along with compensation and litigation expense amounting to Rs. 1,59,114/- in all and further an interest of 10% over and above it in case Yashaswini fails to pay the amount in one month's time.
