ORDER

1. When hearing in this case commenced, learned counsel for the complainant produced photostat copy of letter dated 3.12.2009, issued by opposite party No.1, it contains the terms of settlement between the parties, which is ordered to be taken on record.



2. On instructions received from his client Sh. Rajesh Kumar, learned counsel for the complainant submitted that he has instructions not to press this complaint since matter has amicably been settled between the parties in terms of the letter dated 3.12.2009. His client has already deposited Rs. 2 lacs and is

going to deposit the remaining amount of Rs. 3 lacs on or before 31.12.2009, besides paying the rest of the amount as detailed in the letter.





3. Complaint is dismissed in view of out of court settlement arrived at between the parties.



4. All interim orders passed from time to time shall stand vacated forthwith.


5. Learned counsel for the parties have undertaken to collect copy of this order free of cost from the Court Secretary as per Rules.
