Complaint on your Fraudulent Practices & Cheating & various other grievances
Dear Sir,
We have purchase a Fiat Punto-Emotiones on 25/08/09 by paying 20,000/ booking amount
& Rs. 2.76 lacs down payment including 5370 Advance EMI loan. For the rest amount
we have took a loan from TATA FINANCE done by Techno Auto Mobile Pvt. Ltd. I regret
to inform you that since then we have never received any loan details from your side
neither even payment breakup. I also wish to inform you that we have made One
advance EMI payment Rs. 5370/- along with our booking amount. And as per your
Executive Mr Jaiveer –Sales Executive-Techno Auto Mobile Pvt. Ltd, Najafgarh- And
Mr. Raman- Finance Manager-Techno Auto Mobile Pvt. Ltd, Dwarka, our Next EMI was
supposed to debit on in the month of October 2009. All the communication with them
was purely verbal as according to them we were supposed to get all the papers within
a week time from their Pune/Mumbai Office(As your both the executive were not sure
that the papers will be coming from Pune office or
Mumbai office).
Suddenly on Tuesday dated 15/09/09, I got a message from my ICICI bank that my
cheque# 457781, bank ICICI has been bounced due to insufficient fund on 15/09/09.
I was just shocked to see it & Immediately called up Mr. Raman-Manager Finance-
Techno Auto Mobile Pvt. Ltd, Dwarka, that how come they have deposited the cheque
even we have not completed our first month after purchasing the car HOW CAN THEY PUT
MY CHEQUE INPITE OF THE FACT THAT I HAVE ENROLLED FOR THE ECS. Just a day before I
had spoken to Mr. Raman for my EMI & according to him it had to be happened on 2nd
of every month so this EMI was supposed to Debit on 2nd October 2009, hence there is
no point to deposit my EMI cheque on 15th September.
After dishonoring the cheque I have kept on talking to Raman & Jaiveer various time
but they did not have any information regarding this. After calling them various
times Raman said that its Jaiveer’s fault as he is new joined he must have forgotten
to inform about my EMI date(even though a day before Mr. Raman only said that my EMI
date would be 2nd of every month)And as per Jaiveer even he was not aware of this &
never ever informed by Raman. I asked Raman & Jaiveer to provide me the contact
number of their RM but they bluntly refused that they cannot provide me the number
as they do not have it. It is a deep injury on my/our self respect why I should pay
the cheque bounce/fine charges to my bank & to you too as well in spite of the fact
that there is no fault of mine. I have not received any break up regarding my loan I
was never informed that my cheque will be deposited on 15th moreover I have given
one signed letter from My ICICI bank for
ECS then how can they put my cheque I was never ever informed that my cheque will
be deposited on 15th Oct 2009, But Raman has assured me that he would wave off the
bouncing charges which has been levied by Tata Finance.
Now after talking them so many times they did not responded to collect the cheque
neither cash. Finally I got a call from Raj kumar- Asst Manager Finance- Techno Auto
Mobile Pvt. Ltd, Dwarka on Monday 21/09/09 at 11.02 a.m that if they can send
somebody to collect the cheque amount I agreed. But he also said that I need to pay
the bouncing charges as well other wise my name will be put in CIBIL.
MAY I KNOW WHY WILL YOU PUT MY NAME IN CIBIL WITHOUT ANY FAULT OF MINE???
I clearly told them that till now I have not received any break up regarding my
loan, I was never informed that my cheque will be deposited on 15th moreover it was
promised by Raman that he will wave off these charges. Rajkumar said Ok just make
the payment & after that we will put one e-mail at Customer care & these charges
will be waived off. Any how I asked him to take the address. But Till 21/09/09, 2.30
no Phone call came. At last I myself called Raj kumar- Asst Manager Finance- Techno
Auto Mobile Pvt. Ltd, Dwarka & gave the address even then my cheque has not been
collected on the same day as promised.
Now Today again I had to call them for the same issue(Rajkumar & Raman) THIS IS THE
HIGHT OF HARRASMENT!!!!!!.
Finally my cheque has been collected at today 2.20 p.m Dated; 22/09/09.
As informed to your executive Raman & Jaiveer if you are really interested in a
settlement please let me have all details about payments from you with complete
clarity & wave off the fine charges on me without any further delay failing which I
will proceed with my final consequential action.
Please treat this as my first written notice for all legal purposes & approaching to
consumer forum etc as the case may be. I will also approach Media, websites and my
other known members of Tata Motor finance if so required. So, please therefore fail
NOT in redressal, otherwise you will have to face all the consequences arising out
of this process.
All my complaints are related to fraudulent practices being followed by your company
including the following:
1. Breach of understanding,
2. You collect money in this manner in advance and clients are left with NO
option but to face inconvenience and harassment
3. Lack of even basic services.
4. Not giving services in lieu of money charged,
5. Not informing correct information about loan date in proper manner
6. When followed up, informing in a manner suiting to your needs at the cost of
client,
7. Using all possible ways to harass the client and let them suffer,
8. Reply to complaints in manner suitable to you
9. Never reply to the queries not favorable to you and thus never reply in FULL
10. Take excuse of telephone.
11. Many more points
As informed to you earlier also above have resulted in to the following:
1. Wasting my time which has various impacts on me including impact on my job,
mental pressure & financial loss to me,
2. Serious inconvenience to me/us,
3. Injury on my/our self respect with My ICICI Bank as my cheque have never been
bounced!,
4. Mental agony & unrest of mind to me/us,
5. Harassment to me/us,
6. Physical & Financial damage to me/us, -----------------------& so on?
Further actions to be initiated by me will involve lodging claims for various
compensations from you on account of above defaults/offences by you.
