I am a Govt. servant at Space Applications Centre (ISRO), Ahmedabad. I have purchased a thrre bed room flat (130 sq. yard) from Swarshilp Properties Ltd., Ahmedabad and become occupant of the same in August 2002 after taking HBA (4,71,000/-) from Govt.of India in addition to investing 1, 35,000 from my PF. I spent about 10.00 lakhs including flat, painting and furnitures. My office got it mortagaged through registrar office within a year without any hindrance. I have possession letter, share certificate, cerficate from Govt. Pleader. After one and half year, the textile processors' Bank Cooperative Private Ltd. , Ahmedabad sent notice through collector to me and such other people (they have taken loan from builder , partially repaid and staying without possession letter) that Builder has taken loan in the name of one person in 2001 mortgaging the same flat. I lodged FIR against the builder. But Police said builder is absconding and is not taking any serious action. The office of the builder is closed. I have proof that the name of the person against whom the builder took the loan is not fake. The bank has been liquidated. The liquidator filed FIR against builder and Board of Directors of Bank after my FIR. Board of Directors were in Jail and released on bail after depositing Rs. 80 lakhs to Bank in corpus fund. I filed petition in High court and later Ahmedabad district court against the bank. The bank is trying to drag me to settle the things in DRT which is very expensive.
I want to purchase a new house after selling this flat.
My queries are :
1. How can I sell my present flat without paying anything to bank ?
2. Can I make the bank adjust the loss against the flat from deposit of Rs. 80 lakhs from Board of Directors ?
3. Can I charge from Bank due to mental harassment to me and my family which caused loss in our work productivity ?
