My Compaq laptop warranty was expired around 2 years back but from some sources I came to know that a company called Emm Aar Traders, 205, 2nd Floor, TC Jaina Tower III, Janakpuri, New Delhi is providing extended warranty of Compaq/HP laptop.

At the time of giving the service warranty they asked me whether the laptop is working or not. I told them that it is not functional from last one week but still they provided me one year warranty. They have not provided me any kind of terms and conditions or even get it signed told me that AMC pack will be made available to you in 21 working days. But when I called constantly to them then only they made available me a paper related to HP Care Pack and provided me online registration copy of HP Care Pack (after 60 days) of charging an amount of Rs. 6066/-.

I sent my laptop to the HP Service centre where they firstly take the laptop and asked me that they will let me know the status. After couple of hours they called me and told that the laptop is no more eligible for HP Care Pack Services Certificate as it was shown to some third party service provider. I insisted him that after procuring the HP Care Pack I have not shown my Laptop to any service provider. To my strange, he informed me that even I had purchased HP Care Pack after the original warranty was ended around 2 years back, the Laptop should not be shown to any service provider in between (from purchasing date of laptop to till date) the entire term whether the warranty was extended or not. I asked him that at the time of procuring HP Care Pack, nobody has informed about this clause or verified with me that whether the Laptop was shown to other service providers. They asked me to contact the company from where I obtained the HP Care Pack.

I update Emm Aar Traders official about the status of my grievance, to my strange they said that the HP Care Pack is not valid if the Laptop was shown to any third party service provider right from the purchasing date of Laptop. I asked them, if they knows these are the stipulations then why their executive had not informed me at the time of selling HP Care Pack. They expressed their regret and informed me that they can’t do anything in this regard. There are no clear parameters defined or explained to their executives, by which they can inform customers about the obligations which may arises resulting customers with nothing in hand and felt cheated.

I seek your guidance whether my case is appropriate to filing a consumer case against the company or not??? I had already given the company an one month notice before filing the case, but till date have not received any response.
