Dear Sir:
I came to visit consumercourt.in. I saw several people worldwide
experiencing my kind of issue. Below is the complaint I registered with HP
as: CCHSAP225499 on 12-08-09. I did this as per advice obtained from
National Consumer helpline.
*"I bought my Compaq Presario laptop on 31-03-07. Laptop details are as
follows.
Model No: V3228AU
Product No. RZ819PA
Serial No. 2CE7070FXJ
The laptop was heating since I bought the laptop. Firstly I thought
that it is not going to cause any complaint because of heating.
After 9 months, wifi stopped working.
After 11 months motherboard failed and HP replaced it on March 2008.
The heating was still there. You can sense it by just placing your
hand on the palm rest area or the readings of inbuilt temperature
sensors.
Due to heating, battery life was also shortened. So I requested a
replacement on 26th March. But they said that they are unable to log
my replacement request, because in their system my laptop's warranty
expired on 23rd March 08. So I forwarded an email to HP support saying
that I purchased it on 31-3-07 only. As there was no response, I
emailed the then president of HP, Mr.Balu Doriasamy in May 08 and
based on the same, Mr.Rakesh and Mz.Shivani called me from HP Banglore
office and arranged battery replacement.
Meanwhile HP offerred a limited extended warranty
(
on certain series of laptops for 1 year from the expiry of base
warranty or 3 months after the last service under the same warranty,
whichever is later. May laptop was also included in the series.
Again in March 09, the motherboard failed. HP replaced the motherboard
for the second time under the above said warranty. Heating is still
intact.
Just after 1 and a half months motherboard failed again and under the
same warranty, HP replaced it. Heating is still there.
HP replaced the motherboard again, for the fourth time on 2-7-09.
Heating is still there.
As an electronics engineer, to the best of my knowledge, I understand
that the issue is caused by the inefficient thermal design in the
series of these laptops worldwide, which cannot be solved by replacing
the motherboard. Replacing the motherboard is simply like removing the
effect a problem, rather than cause of the problem. Moreover, if a
single time repair can solve the issue, HP wouldn't have offered such
a repair, rather than providing 1 year limited warranty.
I had contacted National Consumer Helpline and as per their advice, I
am requesting a replacement of the laptop with one year warranty to
make sure that rep. Also note that I have already given the laptop to
the Nortech service centre several times by now for diagnosis. Each
time I had to travel 60kms to and fro. Whenever the laptop was there
at the service centre, I was unable to work for those days. Moreover
the defect being thermal design failure, life of all parts are
affected. Be reminded about the fact that improper thermal deisgn
would decrease the life of electronic components exponentially. So
kindly avoid lagging further by 'escalating' the matter. If I didn't
find any response to this email, a letter will be sent to HP head
office in Bangalore. If no satisfactory response from their also, then
I will be constrained to handover the matter to legal experts and HP
will have to pay a higher price including compensation for the damages
incurred to me.

I am thinking of sending a letter via registered post to their Bangalore
head office on Saturday, 15-8-09.

My doubt is it whether should I send it to HP President(PSG), Mr.Ravi
Swaminathan rather than Chairman and Managing Director?
What all documents will be required from my end, if I take the case to
consumer court?
I have the call reports of last 3 motherboard replacements. The first being
17 months back, I don't have either case id or call report. When I asked the
consumer helpline, they told its not an issue. I do have the invoice with
me. As of now, only motherboard is covered under warranty or its a kind of *
very* limited warranty.
Hope I will get a replacement. Actually I am not interested in replacement,
because of the fact that several HP laptop has heating and allied issues.
There are several articles on supporting this fact. The replaced laptop can
also cause problem. So can I claim for a refund rather?
In Cochin, Kerala, Mr.Koshy John filed a case and he won. Another person
from Ludhiyana also won. The below links lead to them and may come in handy
for you as well.
Please tell me whether I should go to court. Am I elgible to claim?
