The complainant has filed this complaint with his grievance that he had purchased a mobile from the opposite party which has gone out of order within a short span and he had given it twice for repair to opposite party, but again come for repair and he has given that mobile to the opposite party, but he has not collected back and contended he do not want repair mobile but he wants a new mobile in place of the old one. As evident from the complainant, the complainant has not taken back the repaired mobile unless manufacturing defect is proved, this Forum cannot order for replacement of mobile with a new one. Therefore complainant is at liberty to take back the repair mobile, use it and if he find any defect he is at liberty to approach this Forum. With this the complaint is dismissed at the stage of admission.
