Present : Sh. A.P. Singh Advocate for the complainant.
After going through allegations of the complainant contained in the complaint, we are of the view that complaint is not maintainable, as no deficiency on the part of opposite party is made out.
Complainant had hired marriage palace of opposite party for reception party of his son on 7.12.2008. At 9.15 p.m. electricity went off and no alternative arrangement was done by the opposite party. Hence, alleged that taking advantage of darkness ladies in the party were outraged and many guests went away without taking dinner. Food got wasted. This happened due to non providing of electricity by the opposite party. Hence, claiming such act as deficiency in service, file the present complaint under section 12 of the Consumer Protection Act, 1986, for compensation.
There is nothing on the record that electricity went off due to any fault or negligence of the opposite party and due to his own act. Even the electricity failure due to reason is beyond control of the opposite party, therefore, can not be held liable for deficiency in service. In such circumstances, the complaint not admitted. Be registered. File be consigned to record. Copy of the order be supplied to the complainant free of cost.
