    Daya Shankar son of Sh. Ram Adhar, allotee EWS house 1522 at present resident of 3340, EWS House, Chandigarh Road, Ludhiana.

    Greater Ludhiana Area Development Authority, Ferozepur Road, Ludhiana through Estate Officer (GLADA) (Previously known as Punjab Urban Planning & Development Authority)

    (Opposite party)



    Complaint under section 12 of the Consumer Protection act, 1986.



    Quorum:

    Sh. T.N. Vaidya, President.

    Sh. Rajesh Kumar, Member.



    Present:

    Sh. M.S. Sethi Advocate for the complainant.

    Sh Gurvinder Singh Sodhi Advocate for opposite party.

    O R D E R

    T.N. VAIDYA, PRESIDENT:

    1. This order shall dispose off an application filed by opposite party for dismissal of the complaint.

    2. We have gone through the record and find weight in prayer of the opposite party. Because, opposite party earlier in compliant no. 186 of 22.4.1998 had filed similar complaint qua allotment of EWS house no.1522 and that he was not given possession. That complaint was dismissed vide order dated 5.11.1998 by this Fora. Again same relief, in this complaint is claimed by the complainant. Hence, the complaint is not maintainable.

    3. In such circumstances, application of the opposite party filed for dismissal of the complaint is allowed. Consequently complaint dismissed. We leave the parties to bear their own costs. Copy of the order be supplied to the parties free of costs. File be completed and consigned to record.

    Raise complaints against builder in ccccore.co.in (Ind. govt. site)
    they will provide Great help and issue will resolve in time.
