    Heard Mr.Hemant Prabhulkar-Advocate for the appellant. None for respondent.

    Perused the order dated 19/11/2005 passed by Mumbai Suburban District Consumer Forum, which is under challenge. The complainant carried in all three bags. He received only two bags on 16/3/2003. One bag was found lost. However bag was traced on 19/3/2003 and same was delivered to the complainant. Complainant found that two Sarees, Two chocolate boxes and one biscuit box were found missing from the bag. When complaint was lodged, Air India has taken a stand that passenger should have brought this fact to notice of the authorities of Air India before or at the time of delivery of bags. Complainant has made it clear that the sticker was placed on the hole, which was not noticed at the time of delivery of the bag. When sticker was removed, that time only the complainant found that his bag was tampered. District Consumer Forum awarded 85 US dollars. As per Warsa Convention, limited liability is fixed to the extent of 20 US dollars. Warsa Convention is not considered by the District Consumer Forum. We therefore, pass following order:-

    ORDER

    1. Appeal is partly allowed.

    2. In clause no.2 of the operative part of the order, instead of “85 US dollars” it should be read as “20 US dollars”.

    3. Rest of the order stands confirmed.

    4. Misc. application stands disposed of.

    5. Pronounced and dictated in the open court.

    6. Copies of the order be furnished to the parties.

    My flight landed in Mumbai on the 17 th of december 2009 and till date I hav not recieved my baggage ...since 3 days I am being asked to call after 2 hours and yet I do not even know my status..

    For 3 days I am told that my baggage has come from london and is lying in delhi but now I was informed that my bag was never in delhi...I dont know whats going on..

    I call the given number 10 times, and then they answer .They tell me that "I cannot do anything if you cannot get ur baggage" They hang up on me...I was suppose to attend a meeting in Calcutta but I had to cancel it because I have some important documents in the bag that is with Air India..

    I have made the biggest mistake of my life by choosing Air India ..I can assure you that I or any of my relatives or friends are ever going to travel in Air India.

    Thumbs up MISSING OF 03 SUITCASES during journey from New Delhi IND to Hong Kong by Air India

    To, All Air India Authority, Aviation Minister (Govt. of India)

    Subject – Complaint regarding MISSING OF THREE SUITCASES during journey from New Delhi (India) to Hong Kong by flight number A1-314 on dated 16/10/2010 arrived on 17/10/2010 at 7:00 a.m. at Hong Kong (Baggage Tag number A1-458238, A1-458239, A1-458240)

    Dear Sir,
    Kindly refer our mail dated 17/10/2010 at 8:15 p.m. I took flight on dated 16/10/2010 at night by air India flight number A1-314 from New Delhi (India) and arrived Hong Kong on 17/10/2010 at 7:00 a.m. At Hong Kong my baggage Tag number A1-458238, A1-458239, A1-458240 containing three suitcases were found missing / not arrived at the destination. On enquiry, airport authority issued me a slip (photocopy / scan copy enclosed) for above missing three suitcases and took original baggage tag receipt issued by New Delhi airport authorities from me. Further they assured me that they will send my above suitcases at SANMAO Hotel Guangzhou (China) to my next destination.
    I stayed at SANMAO Hotel Guangzhou from dated 17/10/2010 to 19/10/2010 but didn’t received my above three suitcases. I also informed the same to airport authorities through phones/calls and emails but didn’t received any satisfactory answer. They only assured me that they are arranging to send my suitcases at SANMAO Hotel Guangzhou. During my visit to china from dated 17/10/2010 to 30/10/2010, I visited several cities of china and also stayed there. My hotel was not booked for the journey from dated 19/10/2010 to 30/10/2010, so I couldn’t make any correspondence with airport authorities.
    I have reached India by AI 0349 flight on dated 31/10/2010 morning “After Four Hours Flight Late”. But I have neither received my suitcases nor any information about it. Mr. Andy chan, customer services officer of Hong Kong airport authority committed to pay compensation along with three suitcases but they also failed to fulfill the same.
    I have to suffer a lot physically and mentally due to non availability of my luggage because the purpose of my China visit was to attend trade fair and to meet business houses. But my clothes, food, valuables, business cards, references, files, and other important documents were lying in the suitcases (detail list enclosed) not meet them in the fair. I also could not meet other business houses in China due to which I had to suffer heavy financial loss.
    I again request you to search out my suitcases and send at my following address at the earliest along with compensation for 24 days of mentally / physically torcher / harassment and financial loss which come to Rs. 18 lacs.
    If my problem is not solved within 15 days, there will be no option other than to move to consumer court and criminal court for which you shall be fully responsible.

    Default Lost baggage on flight IC814 Kathmandu-Delhi on 2010-11-06

    Despite efforts of Tallinn Airport yet no information about a lost backpack. Probably an arranged theft. By transfer in Delhi we discovered that we have only 3 tags instead 4: AI100509, AI100510 and AI100512. And in Tallinn we got only 3 items of baggage.

    Default Loss of Laptop from checked in Baggage on Air India Flight AI 102

    I travelled on the 28th October on Air India flight AI 102 from JFK, New York to Mumbai via Delhi. I arrived in mumbai on the 29th at 2200hrs and inspected my checked in bags to realise that my DELL inspiron laptop was missing. On the 30th morning, I called Air India customer service and they did not entertain my complaint and refused to take any responsibilities. I then went to the Mumbai international airport and enquired on the help desk. I was directed to the lost and found dept who courteously checked and found no dell laptop with them. I was then directed to the MIAL officer on the airport (Duty Manager) who made me wait for 2 hours and then said that they dont have my laptop and asked me to talk to the arrivals customs. When i explained the situation to customs they told me that this was a case of theft by the air india staff or loaders and asked to lodge a complaint with Air India. I have now filled a feedback form on the Air india website as there was no form for complaints. It was totally a frustating experience.

    We pay high air fares and are asked to keep our bags unlocked. We entrust them with our valuables and this is what we get in return. I am highly disappointed with Air India. I request you to look into the matter and help me find my valuable laptop and give me justice.

    Dear sir, returning from riyad to newdelhi via mumbai by flight ai921 on dtd 22.10.2011,ticket no.0982966540100,tag ai648294, i not found my baggage ,i complaint a file no.89088 at cst mumbai, but till date i not found , i am contect to air port from returning date but no solution take place, i contect at cst mumbai on ph. No.but all in vain,on dtd 12.11.2011 i approached to cst baggage section and attending officer mr.kailash kantaria told me that your bag has been send to newdelhi on dated 25.10.2011 then i went to new delhi on dated 14.11.2011 but they told me that no bag has been arrived,sir,i went two times from my native place (sikar ,rajasthan) to mumbai and one time igi airport new delhi ,i have spent rs.6000/- in this roud trip puzzle,who will responsible for my money and my lost bag, i think it is my greatest mistake of my life to journey my air india flight, now at last ho'ble court is last option for me to mis guide by your staff,lost my bag and spend a lot of money,if within two days i not found a reply from your side.     Respected sir I m PRASAD THAPA Malyangkot 8 Syangja NEPAL and I have come NEPAL to USA at 17 novemver 2010 actually my flight date is 16 november 2010 but due to AIR INDIA flight problem they cancelled and postponed to 17 november 2011 My transit is NEPAL to DELHI (INDIRA DANDHI AIRPORT) by AIR INDIA IC 814 DELHI to LONDON by British Airways BA 142 and LONDON to BWI(USA) by BRITISH AIRWAYS BA229 at 18 november 2011
    When transit in Delhi AIRPORT there is no given me permision to check my baggae and 2 official worker of BRITISH AIRWAYS in delhi tell me that you doesnot need to show your baggage just give me your BAGGAGE tag no and we will deliver to your bag at the immigration place and i give them my BAGGAGE tag no as IC 0067592 and IC 0067593
    of my 2 baggage and one lady official worker of BRITISH AIRWAY in DELHI note my two above baggage tag no and give me permission to traval forward Finally when the flight is ready to flight baggage tag no checker man tell me that THAPA your 1 bag is missing we cannot find it Dont worry you will find your bag at reporting to immagration place BWI (USA) and due to his suggestion i report to missing 1 bag out of my 2 bag but which on tag no bag is lost i dont no because DELHI AIRPORT giveme only one next proceed tag no as BRITISH AIRWAYS THAPA 034E35 WASHINGTON BWI BA 229/18 november LHR BA 142/18 NOV BA 031651 and I report that at BWI airport and now I have a proof of report my missing bag photo in my mobile and key of my missing bag and waiting my lossing bag because there is my personal important thing EXACTLY by above information my bag is missing by AIR INDIA IC 814 on NOVEMBER 17 2010 So PLEASE try to find out my missing bag and give the information by this address (Now I m the green card holder of USA) PRASAD THAPA 8834 TAMAR DR apt 301 columbia MD 21045 CONTACT 14102947868 Thanks

    Default lost baggage irresponsibility

    Hi, I travelled with air india before 3 days from toronto to delhi to ahmedabad . Upon arrival to ahmedabad I found that one of my 2 checked-in baggages was missing . I was asked to fill in the property irregularity form and was told that I would receive my bag within 2 days. I was also given a contact number on which there is no response ever. This is very irresponsible as I have the most important documents in that bag and also my clothes. So what am i supposed to do if the authorities do not respond at all ?

    Default Lost bag- no response after 1 month

    Air India lost my bag after my flight from Goa-mumbai-delhi- heathrow. December 07 2011

    My flight wasn't supposed to stop at Mumbai but did, randomly. I was instructed to stay on the plane for an hour and then we would proceed to Delhi. Flight AI866 to Mumbai and Delhi and then flight AI 866 to Heathrow from Delhi but this number changed to AI111.

    I arrived at heathrow and my bag didn't turn up. I followed procedures, after 7 days it was handed over to Air India department. They have sent messages to Goa, Mumbai and Delhi. Only Mumbai have responded saying they dont have the bag. Nobody is being very helpful and it is very difficult to even get through to Air India desk at heathrow as they never answer and impossible to get hold of any officials at Delhi or Goa.

    I had a lot of very sentimental items in the bag as I was away for 4 months and 15 months prior to this in Thailand. I am devastated about this sittuation and need to either be compensated for my loss or to find the bag.

    I have written a letter of complaint along with the official printout baggage loss form I recieved at heathrow and my check in bag tag and sent a claim to Air India in Heathrow and they havent responded after two weeks.

    It was a large grey suitcase with hard black handle soft standup bag weighing 36kg. If this sittuation is not resolved soon I will proceed with legal action.

    My flight landed in Bhubaneswar on the 23rd of december 2011 and till date I hav not recieved my baggage ...since 10 days I am being asked to call after 6 hours and yet I do not even know my status..
    Actually I came from Jaipur to New Delhi
    and next, from New Delhi to Bhbaneswar.When my flight landed in Bhubaneswar i did not find my luggage which is long black in color contains with new saree, badsheet and new pant-shirt which is near about cost Rs 25000.00 .

    I called air india enquiry in every 6 hour,but no result from that side. If I am not found this luggage, it is sure i have to bound to go Consemer court for this matter.

    I have made the biggest mistake of my life by choosing Air India ..I can assure you that I or any of my relatives or friends are ever going to travel in Air India.
