This revision is against the order dated 27.1.2009 passed by the learned District Forum, Jodhpur whereby the learned District Forum while disposing of Misc. Application directed the Petitioner to give electric connection to the Complainant without demanding arrears which were due from the former occupier of the premises.


The Complainant had purchased a Factory auctioned by the Department of Commercial Taxes for which the Complainant applied for electric connection but the connection was not given on the ground that arrears due from the former occupier should be paid by the Complainant. The learned District Forum relied upon the circulars dated 1.2.2002, 12.11.2002 and the order dated 5.4.2002 issued by the Power Department and allowed the petition as indicated above. It was also mentioned in the impugned order that this is an interim arrangement which shall not affect the merits of the case.


We have heard the learned counsel for the Petitioner at the admission stage. Nothing has been said in the petition about the circulars as mentioned by the learned District Forum in its order. Much stress was laid only on this point that the learned District Forum had no jurisdiction to entertain the complaint as the matter relates to Pali jurisdiction. In our view, this plea is liable to be rejected on the ground that the Petitioner has its office in Jodhpur also and therefore the complaint could be entertained by the learned District Forum, Jodhpur also.

In view of the above, we do not find any force in this revision and the same is dismissed.
