When hearing in this case commenced, learned counsel for the parties stated that the matter has been settled out of court and pursuant to this settlement respondent No.1 has agreed to pay a sum of Rs. 2,500/- in full and final settlement of the claim of the appellant as set out by him in Consumer Complaint No. 332/2001. It has been stated by learned counsel for the respondent No.1 on instructions received from Mr. Amit Gupta, Manager Legal, that this amount will be remitted by means of a cheque on or before 30.4.2009 to the appellant.

2. In view of the aforesaid background, this appeal is disposed of with the direction that the respondent No.1 shall remit sum of Rs. 2,500/- to the appellant by or before 30.4.2009. However in case needful is not done then this amount shall carry interest @ 12 % per annum with effect from 11.12.2001 till the date of payment. Appeal is disposed of with the aforesaid agreement, leaving the parties to bear their own costs and order of District Forum below in Complaint No. 332/2001, dated 22.9.2007 stands modified in these terms.

Learned counsel for the parties have undertaken to collect copy of this order from the Court Secretary free of cost as per rules.
