    Default Judgment against Yashaswini in Andunhi Case DK DF

    Mr. Andunhi, a member of Bellare Agriculutural Co Operative Society was a diabetic and had developed a Carbuncle over the back. He had Yashaswini. He took treatment at Dhanvanthari Hospital Puttur for Rs.4,587/-. The claim was repudiated by Yashaswini Insurance on flimsy grounds saying that he had not taken treatment in a hospital empaneled by the scheme. This argument he knew was rubbish. There were several precedences in which the DF had allowed the claim applications of members taken treatment in other than network hospitals. But poor Yashaswini stuck to its gun of saying the same old cock and bull story, which did not go well with the Dakshina Kannada District Forum.

    As a result Yashaswini was compelled to pay not only Rs.4587/= but also 8% compensation from the date of discharge till the date of realization.

    In this case, 214/2011, Andunhi Vs Yashaswini and Bellare Cooperative Agricultural Bank, Yashaswini chose to pay up the entire amount along with up to date interest and cost of litigation - Rs.6,163/- at Consumer Court Mangalore on 22/02/2012. The DD was received by Andunhi's Advocate Mr. Sanjay D in full and final settlement.

    Had Andunhi gone to a Networked Hospital, he would not have got a single penny as the scheme would have then rejected his claim saying that I and D procedure for Carbuncle was not covered under the scheme. Therefore moral of the story is that one must get his appropriate treatment in any hospital which he prefers and then prefer a claim. If not honoured resort to Consumer Litigation, which will result in full payment.
