    The present Appeal has been directed against the judgement and order dt. 1.12.08 passed by the Ld. District Consumer Disputes Redressal Forum, Kolkata, Unit-II in Case No. CDF/Unit-II/C.C.No. 50 of 2007 wherein the Ld. District Forum dismissed the complaint petition on contest without cost.

    The case of the complainant before the Ld. District Forum, in brief, was that one M/s. Paste Box India, a partnership firm, through its partners purchased 4 National Savings Certificates for Rs. 1,000/- each and 2 National Savings Certificates for Rs. 100/- each, the total value being Rs. 4,200/-, from the Respondent concern on 16.6.1973, the maturity date being 16.6.1980. The partnership consisted of two partners, one being Mr. G.P.Lala, since deceased, and the other being the Appellant. It was the complainant’s further case that the certificates were deposited by the firm with the Assistant Collector of Central Excise, Assessment Unit No. 6 as security deposit. On the application of the complainant a request was made for stop-payment on the ground of dissolution of the partnership firm. After settlement amongst the partners of the firm, the securities were encashed, but no post-maturity interest was given by the Respondent concern to the Appellant, which compelled the complainant to institute the case before the Ld. District Forum.

    The OP/Respondent contested the case by filing written objection thereby denying all the material averments of the petition of complaint contending inter alia that there was no deficiency at the instance of the OP. The delay which might have been caused for payment was due to the fact that the partnership firm got dissolved and subsequently after settlement okf disputes amongst the partners the payment was made. The prayer for post-maturity interest as claimed by the complainant was not tenable as the day on which the payment was made there was no such provision for giving any post-maturity interest. According to the OP, such sort of enactment came into force in the year 2003, long after the payment was made and considering all these aspects there was no merit in the petition of complaint and the same is liable to be dismissed with cost.

    The Ld. Forum while disposing of the case has observed that there was no deficiency or laches on the part of the OP and that the complainant was not entitled to any post-maturity interest as no such rule existed when the payment was made to the complainant and accordingly, dismissed the petition of complaint as mentioned above.

    The only moot question that revolves round the present Appeal is as to whether the Ld. District Forum was justified enough in disposing of the case in the manner as discussed above.
    DECISION WITH REASONS

    At the time of hearing the Ld. Advocate for the Appellant has urged before us that there is practically no evidence on the point of such delayed payment made by the Respondent as regards the maturity value of the security deposits. In this connection it is also submitted on behalf of the Appellant that when there is no existence of a circular as regards payment of post-maturity interest, there is no point in disallowing such benefit of the complainant when on the face of record it has become apparent that there was inordinate delay in payment of maturity value to the complainant. While concluding his submissions the Ld. Advocate for the Appellant has submitted before us that the Respondent concern is not a profit-earning concern and there was no point in enjoying the usufruct of the security money by the Respondent concern and for this reason only it was incumbent upon the Respondent concern to make payment of post-maturity interest, whatever may be the date of promulgation of the circular in this regard. The Ld. Advocate has also criticized the impugned judgement in this regard, according to whom, the Ld. District Forum did not appreciate the actual state of affairs and has arrived at a wrong and improper decision, which is liable to set aside.

    We have duly considered the submissions put forward on behalf of the Appellant as mentioned above and have also gone through the materials on record including the impugned judgement and find that in this case it is an admitted position that there was dissolution of the partnership firm which purchased the valuable securities in the form of National Savings Certificate and that there were some internal dues amongst the partners and ultimately after settlement of the disputes amongst the partners the maturity value was paid and prior to that there was a request at the instance of the complainant to stop payment. In this regard we also take note of the fact that the circular as regards post-maturity interest came into force in November, 2003. If that be the position, when admittedly the maturity value was paid much before the said date of November, 2003, we find no point in scrutinizing the facts and circumstances of the case and the materials on record on the demand of the complainant/Appellant for entitlement of his post-maturity interest. We have also gone through the impugned judgement and find that the Ld. District Forum has applied its mind to the pros and cons of the respective parties’ cases and has arrived at a just and proper decision and accordingly, we are not inclined to interefere with the finding of the District Forum in this regard. Considering the present matter in the light of above observation we find no merit in the present Appeal and the same is liable to be dismissed.

    Hence, it is ORDERED that the Appeal stands dismissed on contest without cost.

    Default Short payment of interest SCSS Account 78149

    SCSS A/c 78149 : Short Payment of part-qly interest on 01 / 12 / 09

    We wish to draw your attention to the concluding lines of the penultimate para of circular no
    SB/R-1313/Cheque/1/2000 dated 14.02.2003 from the Chief Postmaster General : West Bengal
    Circle, Yogayog Bhawan : Kolkata - 700 012 reading as under ;
    " ... it is further clarified that in all cases including past cases, the date of credit in POSB
    scheme should be the date of debit of the cheque from the depositor's account. "

    Please note the following :

    1. Our cheque for Rs.8 lacs in respect of SCSS A/c no.78149 was debited from our Bank A/c
    on 29.07.2009 - that is the date from which 9% interest p.a / part thereof should be counted
    and paid and 5 years from that date should be the DATE OF MATURITY OF OUR A/C
    ie., 28.07.2014 and not 19.08.2014 as wrongly mentioned by your Mr.Abdul Razzaq
    Mollah in the passbook. Kindly have this error rectified at the earliest.Copy of ING Vysya
    Bank statement attached.

    2.The part interest paid on 01.12.2009 should be for 64 days : July - 3 days ( from 29th to 31st),
    August - 31 days & September - 30 days.

    3. Interest @9 % p.a on our deposit of Rs.8 lacs works out to Rs.72,000.00 p.a - which divided by
    365 days works out to Rs.197.26 per day.Therefore , part interest for 64 days as stated in
    2 above should be Rs.197.26 x 64 = Rs.12624.65 , say rounded up to Rs.12625.00 But you
    paid us only Rs 8609.00 . In other words , you paid Rs.4016.00 less ( Rs.12625 - Rs.8609).

    4. On Thursday, April 01, 2010, we shall come to collect our qly.interest. Shall be grateful
    if you kindly advise the person concerned to pay us alongwith with our qly.interest . the
    earlier deficit of Rs.4016.00 the same day.

    Default Non-credit of quarterly int. on SCSS deposits to savings a/c at GPO Kolkata

    Since extension on 28/09/2009, quarterly interests on my deposits under Senior Citizen Savings (SCSS) A/c No. 110863 are not credited to my savings a/c no. 1353485 (both maintained at GPO, Kolkata) inspite of submission of fresh application for such automatic credit. Earlier, during initial 5 years, it was being regularly credited.
    I request you to look into it and help me in getting my quarterly interests duly credited in conformance to rule no. 7(4) governing Senior Citizen Savings Scheme, 2004.
    With my health condition & age it is not possible for me to go to post office at the end of every quarter and spend the whole day (from morning till fag end in the afternoon) to collect interest cheques.

    To day you have send a three parcel through postman in our company(Bata India Limited), Batanagr, Retail Distribution Centre, Gate No.9, Kolkata 700 140. but at the time of delevery we have asked to postman a documents & he did not listen anything & he presurised to signed a paper which is in his custody & released him but we are disagree to the above process after that he(postman) called inyour post office (Batanagar) to Mrs Rekha Hazra & handover his mobile to me & Mrs Hazra picked up the phone & usage a rough behave with me after that we pesonally met the post master( Mrs. Jharna Khatal)in your office(Batanagar) at that time Mrs Hazra again mis behave with us at the presence of post master & she threatned "YOU CAN DO WHAT EVER YOU LIKE".

    since last few years i am not getting Annual reports of different companies from any of companies where i am a shareholder whereas all others get at kolkata.

    It seems something wrong at Shibpore post office, Howrah withdistribution of those types of mail. Authorities need to check.

    Default Money order of Rs 2000/- Missing ( from Purba Medinipur to Paschim Medinipur )

    Dear Sir,
    I would like to inform you that I have sent a money Order of Rs 2000/- ( Receipt No 88) on 07/09/2010 from Khanjan Chawk ( Haldia ) post Office bearing the PIN Code 721602. This was sent to my Mother( Mr. Tanmoy Batabyal C/O Madhusudan Batabyal , Village Tikayet Pur, P.O. Asanboni, Dist:- Paschim Medinipur. PIN 721507.) for an emergency purpose . Almost 12 days has passed but yet it is not reached there though the Post Master of that particular Office assured me that it would reach to my mother within 4 days.

    In the above said context , you are being requested earnestly to do the needful so that the money can be reached to my mother at your earliest.

    Post total absence of punctuality in attendance

    In view of the assumption that schedule time of opening of a post office is at 9.30 A.M.,I went to the Naktala Post office at about 9.45 A.M.and surprisingly observed that but for an individual looking after Savings Bank section, none has reported.I wanted to procure stamps and met another person came late,loitering inside the counter, to be only advised to the effect that I should have come after 10.30 A.M., the usual time of arrival of the staff members and had also been reported that there is no guarantee that if at all any employee would man the stamp vending counter inasmuch as the concerned employee had long been transferred and no replacement provided.This is an unique experience that when few members did report none is at all keen to help mitigate the travails of customers standing to procure stamps.The person sits just beside the stamp vending counter rudely declined to help out when requested to.IT IS REPORTED BY OTHER WAITING CUSTOMERS THAT THE REPORTING TIME OF ABOUT 80% OF THE MEMBERS OF STAFF OF THE SAID POST OFFICE IS 11A.M.to 11.30 A.M.conspicuously for lady employees.
    2. The state of affairs, prevelant at that post office, is required urently to be changed and order needs to be put in place .You may verify the veracity of the conents of this e-mail by making a surprise visit and find for yourself the extent of hardship your customers have to undergo in order to continue their relationship.

    Default Non payment of NSC since 2003

    Sir, my father have parchase five NSC from Singtam,SIKKIM head post office. It is matured on 8/2/2003. Unfortunitely my father died on 4/2/2003. With relevent paper we gone to Council house street post office,because my father has requsted singtam p.o. to arrange payment of maturity to council house p.o. in writen latter, due to my father transfer from Singtam to kolkatta.Since than we have gone to all relevent post office, with no result.Singtom p.o. says that we have send and Council house p.o. says that we have not recived. We have written letter to many higher authority with no result.
    Sir kindly take nessasary steps

    Default Non Receipt of Bond Certificate

    Dear Sir,

    I have invested in IDFC infra Bonds.I have been allotted '4' bonds against my application.The certificate has been dispatched to me by registered post vide RL no. 0195879 on 21.02.2011.Neither I have received the certificate nor it has not been returned undelivered to The Karvy Computer Share Pvt.Ltd. by the postal authorities.

    Please look into the matter and do the needful at the earliest.

    dear sir,
    i need your help to get in touch over telephone with the sr post master barrackpore post office in consideratiion of his refusal to make reply over telephone to any customer be he or she is a senior citizen or pensioner and to him distance is not the criteria.
    in my case i have deposited the NSS passbook to naihati post master seven days back and due to age and constraints i requested over telephone to inform the number of days usually taken in this type of payment as naihati post master has informed it may take by five days or seven days or even more than month as it is the post master barrackpore post office is the right person to reply.
    but to my utter surprise he simply refused to talk even not recognised any query his simple reply distance or age is not the criteria any query could be solved on personal meeting in his chamber.
    as such i need your help considering my age and inability to go long distance

    I am an Ex-serviceman and dependent on the source of income from pension and MIS.
    My MIS account 73903211 of Rs 1,05,000/- is transferred from Ichhapur Kanthadhar (PIN 743144) under Barrackpore H.P.O to Burnpur (PIN 713325) under Asansol H.P.O on 11 January 2011. Till date I did not received my account at Burnpur.
    On personal query I found, the Index Card is missing at Barrackpore H.P.O. I was advised for re-opening of duplicate Index Card and I did so in the month of April 2011 at Kanthadhar P.O.
    Till date it is not forwarded to Asansol H.P.O.

    Dear sir,
    i am a resident of 164 e linton street, kolkata-700014 falls under entally post office.
    In spite of my repeated complain at entally post office verbally and written no remmedy had yet been provided and being helpless i compelled to lodge my complain to you with great hope.

    All my letters comming are being delivered to my land lord who reside at 164b and i am in 164 e .land lord offered some tips to them and they deliver all my letter to their post box instead of my post box. Land lord got some vested interest to harass me and my family due to some dispute on vacating the house which i rented 25 years back.
    Due to non recpt of all my dak i misses interview etc, a number of devidend cheques are not receiving to me as it was delivred to land lord and they torn and throw. In such manner i am loosing a lot due to iresponsibly delivered my letter to to the box of house no. 164b instead of 164e.

    I accordingly request you to pl look in to the matter and direct your entally post office to deliver my letter in my box only.

    Default Non delivery of all my letters to my letter box

    Regret to bring to your kind notice that i resides at 164e linton street,kolkata-700014,which falls under your entally post office. My all letters are being delivered to the box of 164b instead of 164e and as 164b is my land lord house they destry my all letters. Your peon are being made motivated by my land lord giving small tips to deliver all my dak to their box which put me and my family in hues loss as devidend cheques are being torn and thrown . Interview letter for my family were also destroyed. I repeatedly requested your entally post office verbally and in written requesting them to deliver all dak in my box but they are not doing so. I accordingly request you to pl adv your entally post office to deliver all my dak in my box only.
