    Default Judgment against Yashaswini in Valangaje GK Bhat

    Gopalakrishna Bhat had a Perianal Abscess. He took treatment from Dhanvanthari Hospital Puttur. He underwent Incision and Drainage Operation under caudal ananesthesia and spent a meager sum of Rs. 6952/- (Rupees Six thousand nine hundred fifty two only) towards the surgery. He enquired about the procedure of sending his claim bills to Yashaswini scheme with Peramogru Milk Co-Op. Society. They said that he should not have gone to Dhanvanthari Hospital. Now that he has already gone there and got his surgery he will not get anything and ridiculed him. They also made him look poorly in front of everyone. He asked them to give that in writing. Cunning secretary of Society would not commit it to writing. GK Bhat smelt a rat. He approached Sanjay D., leading consumer advocate in DK District and issued legal notice to all concerned including the society. Will Yashaswini and Society heed to a legal notice? Never. Legal notice is just another piece of paper. They stuck to their original song of not giving the claim. Society approached Jathanakodi Narayana Prasad, leading advocate in B. C. Road. He rescued the Society's case by transferring the burden of payment to Yashaswini and that Society was just a spectator of the drama.
    Interrogatories and Arguments went thick and strong. Advocates on either side had their share of raw bone in the District Forum Mangalore. Extremely pleased, the Forum said that Yashaswini must cough up all money due to GK Bhat along with 10% interest there to till date of payment. Also Rs.1,000/- Expenses. Narayana Prasad really helped Society come clean out of the mess. Complaint against Society was dismissed.

    Now let us examine what would have happened if Bhat had approached another hospital. He would have been told that Incision and Drainage of an abscess was an excluded surgery under Yashaswini by the doctors. That exclusion list is not provided to Bhat. Poor Bhat who is not expected to have full legal knowledge would have fallen prey to the explanation and would have paid a huge sum, more than Rs.6952/- and he would not have moved the Consumer Forum making Consumer Forum good only on paper.(@*@*).

    Yashaswini registered its Appeal in Appeal No.168/2012 in the State Commission in Bangalore through Advocate Santhosh Kumar MB. But his appeal met with instantaneous DISMISSAL at the stage of admission by the presiding officer rendering Yashaswini liable to pay the entire amount along with interest or choose to go on appeal once again to the National Commission.
