    :- ORAL ORDER :-

    Per Mr.S.R.Khanzode, Hon’ble Presiding Judicial Member:

    1. This appeal arise out of order/award dated 04/02/1999 passed in consumer complaint no. 127/1997, Shri Shivneri Sahakari Bank Ltd. V/s. Superintendent of Post Office, & ors. by District Forum, Kolhapur (Forum below in short).

    2. We heard Adv.Shri A.J.Chougule for appellant and Adv.Shri R.B.Jaiswal for respondent no.1 Shri Vishnu Gholkar/Assistant Superintendent. Rest of the respondents remaining absent in spite of service of notice sent under Certificate of Posting. Perused the record.

    3. As per the complainant, the complainant had sent bills with hundies in the name of Jyoti Enterprises through opposite party no.3 bearing bill nos.3785,3786,3787 dated 15/11/1996 respectively for amount of Rs.10,000/-, Rs.8,502/-, Rs. 9,433/-. Another bill no.219 dated 18/11/1996 amounting to Rs. 30,772/- was sent through opposite party no.4. Earlier also three bills were sent through post office i.e. opposite party no.1. Opposite party no.1 submitted that it delivered the postal articles to the Addressee. Opposite party no.2/ State Bank of India categorically stated that they had not received any bills. We find that Forum below rightly held that there is no deficiency in service that could be alleged on part of opposite party no.2/State Bank of India. As far as opposite party no.1/Post Office is concerned, since they have discharged their part of service by delivering the postal articles to the addressee, there could not be deficiency in service on their part too. As far as opposite party no.3/ Ritco Transport Company is concerned, they came with a statement that they had delivered the goods against the original consignee copy as per the market custom. There is no deficiency in service that could be alleged against opposite party no.5 as it is a non-existing firm. As far as opposite party no.4/Muktagiri Transport Company is concerned, nothing has been alleged to hold that there is relationship of consumer and service provider. As such, opposite party no.4 is not accountable for any deficiency in service on their part. It is tried to be alleged by the complainant that all opposite parties had glove their hands and committed the fraud. But said allegation is without any substance, since the complainant failed to adduce any evidence in support thereof. Secondly, we find no fault with the impugned order and, thus, finding the appeal without any substance, we pass the following order:-







    :-ORDER-:

    1. Appeal stand dismissed subject to cost of Rs.1,000/- to be paid to the respondent/opposite party no.1/Post Office.

    2. Copies of the order herein be furnished to the parties.

    Default Counter clerk-registration,etc. closed before lunch time ie. before 1 pm-Malakpet Colony PO500036

    Sir,

    I was there in the above said post office at 12.59p.m.before the registration counter and it is
    closed and told very badly by the counter clerk on the counter to come after 1.30pm. Concerned sub-master not
    there in the office or any other person to talk.When I asked for the complaint book
    to other person he showed some person as incharge.But, when I asked him,he denied he is not the
    incharge and nobody/responsible officer of post office in the office available in the post office.
    Please note of this complaint and have a enquiry to the post office.
