    Default Regional Provident Fund Commissioner

    Appeal No.403/09

Regional Provident Fund Commissioner & anr.

    Appellants

    V

    1.Parmanand Sharma r/o D.93,Nirman Nagar,Ajmer Road,Jaipur.

    2.State Bank of Bikaner & Jaipur,Shyam Nagar,Jaipur.

    Respondents

    Before:

    Mr.Justice Sunil Kumar Garg-President

    Mr.G.S.Hora-Member

    Shri N.C.Jain,counsel for the appellants

    Date of Judgement: 1.7.09

    Heard at admission stage.

This appeal has been filed by the appellants which were ops no.1 & 2 before the District Forum Camp Jaipur against the order dated 4.1.07 passed by the District Forum Camp Jaipur in complaint no.133/09(117/07 of District Forum-II,Jaipur), by which the complaint of complainant res.no.1 was disposed of in the manner that the appellants were directed to examine the case of complainant res.no.1 in respect of the pension and if the same was found due that may be prepared and further they were directed to pay Rs.2000/- as amount of compensation and Rs.500/- as amount of cost of litigation.

It may be stated here that the District Forum in passing the impugned

    2

order dated 4.1.07 had not passed any mandatory order against the appellants and had only give some directions to examine the case of complainant res.no.1 in respect of the case of his pension.

When this being the position, this Commission does not want to interfere with the findings recorded by the District Forum in the impugned order dated 4.1.07 as according to the appellants no case of pension is found, they are free to pass that order but for that they have to examine the records etc. etc and thus it could not be said that the impugned order suffers from any basic infirmity or illegality.

For reasons as stated above, this appeal filed by the appellants is dismissed with the directions that the appellants are free to pass order in respect of the pension case of complainant res.no.1 either way.
