Beefathima had both a tumour in her uterus and a stone in her gall bladder.
She was advised to undergo Laparoscopic Cholecystectomy and Laparoscopic Hysterectomy in single sitting (one surgery)
by a combination of Surgeon and Gynaecologist Drs. Asphaq Mohammed and Jameela at Yenepoya Speciality Hospital, Mangalore.
She had Yashaswini Insurance. She got the surgery and everything went on smoothly. When Yenepoya hospital sent for financial
authorization. Yashaswini failed to issue pre-authorization. It kept saying the Experts must
say whether the operation was needed or not. When Beefathima was admitted as inpatient, Jameela and Aspahq Mohammad became impatient. They went ahead with the requisite surgery.
Yashaswini pointed fingers at the hospital and said "You operated before I authorized. So now I refuse to pay anything". Beefathima settled the bill of Rs.74,327.81 to the hospital.
Beefathima moved the Consumer court. Prayed for only Rs.60,000/-. Spared the Yashaswini and others the embarassment of remaining Rs.15,000/- (Discount allowed by the poor farmer). Mrs. Asha Shetty, the presiding officer and other Jury came down heavily upon the CEO of Yashaswini Mr. Poovappa for having played this hide and seek game
and warned them (Yashaswini, FHPL and Society) that they could be pulled up for violating the norms set by the IRDA, apart from allowing the complaint and Rs.60,000/- plus interest plus litigation expenses of Rs.1000/-.
