    Default Yeshaswini Health Insurance

    Hi,
    My Mother inlaw is from rural part of bangalore district, Karnataka and they are farmers.
    She was memebr of Govt Health insurance scheme as part of Yeshaswini Health insurance scheme run by govt of Karnataka for farmers.
    During 2007 Nov she was ill, diagnosis with doctors revealed that she has 80% blockage in her arteries. She had to go for immediate heart surgery.
    We admitted her to Wockhardt hospital, bannerghatta road, Bangalore.
    We did said that we have govt health insurance, the hospital people were not sure about the Yeshaswini coverage in Bannerghatta road branch (But Wockhardt hospital, Cunningham road branch, Bangalore was covered under the yeshaswini scheme).
    Since it was emergency we decided not to argue with hospital, we went ahead paid money and got the Bypass surgery doe for her.
    Later hospital said they will not consider Yeshaswini scheme, if you want you produce the claims and get the reimbursement done.
    Hospital gave proper service, we got her discharged.
    We spoke to Yeshaswini Insurance scheme people over phone but no use.
    We sent written documents, no response.
    Finally we filed a case against them at District consumer court bangalore (Case no 1886/2007 at III addl court)
    The case went very well, Yeshaswini Insurance lawyer kept on allegating that my mother inlaw was not at all member of the scheme, we produce the copies of the membership card.
    Finally Honerable judge gave judgement stating "Different branches of the hospital should not be considered seperate, but the complainant failed to produce evidence of being member for Yeshaswini scheme"(disposal date 16-jan-2008)

    We took this to State consumer forum, appealed there, case no 306/2008
    We provided the attested extracts of membership from the society with some more evidence.
    Honerable judge in state court gave judgement stating "there is no doubt about membership, the opposite party should pay complete expenses to the insured person"
    Judgement dated 23-jul-2008
    We were happy thinking we won the case ...

    But the Yeshaswini Insurance had file Revise petitoin in National consumer forum.
    We got a letter and Rs7000 Demand Draft from Yeshaswini insurance company stating
    "As per the instruction of National consumer forum we are sending Rs 7000 to you for your travel expense, we are depositing Rs65000 in national consumer forum as per revise petition no 4789/2008"
    We waited for 2 months, we didn't get any other communication.
    We encashed the DD.
    We tried to hire a lawyer in Delhi, looks like it is becoming too expensive.
    Mean time I'm trying to take help over Internet to find if we can trace when we have the hearing for our case.
    Till today all we got is a letter for Opponent and DD of Rs seven thousand.
    Since it si all most one year over, I'm worried and trying to find out what should be next step.
    I tried calling NCDRC over phone, but they are not ready to tell the status of the case (atleast the hearing date) over phone.


    The revise petition no should be either 4789/2008 OR 4794/2008 case should be between Lelamma N W/O Puttaswamappa Vs Yeshaswini farmers cooperative society.
    Please let me know how can I find the status of this revised petition number being in Bangalore.
    My Mother Inlaw can not travel to Delhi, the are not financially sound to appoint a lawyer in Delhi, what can she do to run the case from Bangalore.

    It is real sad to know about such dreadful situation of health insurance policies in India. I am a health insurance analyser and have been analysing health insurance policies in India. I completely agree that medical insurance policies especially for rural areas needs special care and attention. The government of India should pass laws or interfere with health insurance providers operating in rural areas. However, insurance condition has improved tremendously in urban areas and with health insurance providers like Max Bupa Health Insurance entering the market with flexible, comprehensive policies for people of all age groups, health insurance in India especially in urban areas is on the verge of improvement.
