    ORDER
    The complainant had entered into a construction agreement with the opposite party for purchase of a flat measuring 585 sqft in the first floor bearing flat No.9, N.G.O. Colony, 3rd Street, Abhinaya Foundaton Flats, B.V. Nagar, Nanganallur, Chennai-600 114 for a sale consideration to the opposite party. The land owner registered undivided share of land of 290 sqft of undivided share of land in favour of the complainant. The complainant had occupied the flat in May 2007.

    After occupying the flat, the complainant noticed several defects and deficiencies in the construction of flat. Heavy cracks were found in the walls. Due to poor quality of constructions and single coating of white washing has been done to the walls. OTS has been provided which is not proper sun light and ventilation. The entrance grill gate is not fixed properly. Proper water connection has not been provided. The completion certificate has not been obtained. The opposite party did not rectify the defects. Hence, there is deficiency in service on the part of the opposite parties. The complainant has filed this complaint for directions to the opposite parties to rectify the heavy cracks and other defects as mentioned in the relief column and also payment of Rs.1,00,000/- as compensation for mental agony.

    2. Though notice was served on the opposite party, he did not appear before this Forum. Hence, the opposite party was set exparte.

    3. The complainant has filed Proof Affidavit. Exhibits A1 to A11 were marked on the side of the complainant. No document was marked on the side of the opposite party.

    4. The points that arise for consideration are as follows:


    1) Whether there is any deficiency in service on the

    part of the opposite party.

    2) To what relief the complainant is entitled to?

    5. Point No.1: Admittedly, the complainant had entered into an construction agreement with the opposite party for the purchase of flat measuring 585 sqft in the first floor bearing No.9, N.G.O. Colony,3rd Street, B.V. Nagar, Nanganallur, Chennai-600 114 for sale consideration of Rs.10,00,000/-. Ex A6 is the construction agreement. The complainant paid amounts in various dates to the opposite party. Exhibits A1 to A5 and A7 are the receipts which show the payment to the opposite party. He had also received report from Alandur Municipality for payment of deposit for providing drinking water connection. The opposite party collected sale consideration inclusive of providing drinking water. But, the opposite party did not provide drinking water for the flat. The opposite party did not file any version and documents to rebut the case of the complainant. In the absence of any contra evidence, the evidence of the complainant has to be accepted. On perusal of the documents, we are of the view that there is deficiency in service on the part of the opposite parties. The point is answered accordingly.

    6. Point No.2: In the result, the complaint is allowed. The opposite party is directed to rectify the defects mentioned in para 13(a)(i) to (iv) of the complaint and also directed to obtain completion certificate from the authorities and hand over the same to the complainant. The opposite party is also directed to pay a sum of Rs.50,000/- as compensation for mental agony and Rs.5000/- as cost of the complaint. The defects shall be rectified within two months from the date of receipt of copy of this order, falling which the complainant shall rectify the defects and recover money from the opposite parties. The amount awarded shall be payable within two moths from the date of receipt of copy of this order, failing which the amounts shall carry interest at the rate of 9% per annum till the date of payment.

    Abhinaya Foundations Alwarpet has constructed a flat in chromepet called Saraswathy flats and arranged loans for more than one person for the same house.

    Default Soundharya Foundations alias Search Results Abhinaya Foundations Cheque forgery

    Hi All

    This guy Magesh ( already fixed in a fogery case serach Abhinaya Foundations in google) now operating a construction company called Soundharya Foundations. He started a project in Rajkilpakkam ( Kamarajapuram) and got 4 laks from me and my brother.

    When we verified the details of the properties , we found its illegal to construct flats in the proposed land and he gave brive to govt officiers and got approval for only 2 flats and started constructing more than that.

    He gave us cheques towsrd returning the money but the cheque got bounced. Now I am going to file a case and get stay order for his Soundharya Foundations and working with police to arrest Soundharya as she is the benomy for Magesh.

    Be aware of this forgery guy..

    this guy mahesh already got arrested in mylapore forgery just google: The Hindu : Cities / Chennai : Realtor, aide held for fraud


    & his brother is absconding & most wanted accused by CCB.

    Both have done a big forgery in our flat also RM Meena in Nanganallur.

    here they have registered 6 flats to 10 persons and it is still unsettled. cheated almost all banks in this flat & almost 1 crore forgery here.

    so i request any one who spots ramesh / have his contact recently can please post here his contact # or address.
