Angry Medical Negligence- Wrong blood report and Blood transfusion

Complainant- Rajneesh Roy, Age- 26 years

On february 3rd, I met with an accident where I sustained serious injury on left arm with a glass leaving damaged artery and nerve cells. I was rushed to Moolchand Hospital, South Delhi and was taken in by emergency staff who gave the first aid and in my state of unconsciousness took my left hand thumb impression on several documents which I did not examine at all, nor was that document shown to any of my firends or relative who had rushed me to the hospital. I was and rushed to the operation theatre.

I was aksed for my blood group and since I knew it, I told them it was B+ve. I was kept waiting in the operation theatre for about 2 hours without any doctor and was injected several injections as part of tests and samples to perform the surgery.

I was given anasthesia and the surgery was performened successfully when the surgeon arrived.

As a working employee on a MNC I am covered for any accidental expense. However, the same could not be established because the thumb impression taken by the hospital staff was under Medico Legal case. As a result I payed a sum of Rs. 1 lac for the entire procedure and was dishcharged on 5th Feb.

I was on bed rest for nearly 2 mnths with regular vists to the hospital.

Now after all these days, when i was going torugh my reports to find out the reason for denial of mediclaim. I saw that the hospital staff who was not even a diagnosing doctor had mentioend consumption of alcohol in the admission report and made it a medico legal case. While all my tests show no report of any amount of any alcoholic beverage.
So much so, when I was examining my result I dicscovered that my blodd report was showing as O+ve. I was surprised and the same blood was transfused in my body.

I lost my job, keeping bad health and irregularity at work. And still believed that may be my blood group was O+ve and I may not have known it. However, one fine day I found my receipt of Ganga Ram Hospital where I had participated in blood donation camp and there it showed as B+ve.

Also, having lost work and out of resources, I cound not consult a lawyer or pay an interim fees. I again got my blood test done and the result was B+ve.

Due to sheer negligence of the hospital staff and taking undue advantage of my situation. I have suffered heavy financial loss.

1 lac treatment which I had no problem paying through my mediclaim but because of the hospital staff I cannot. I also approached the administration of the Moolchand hospital and they said, they cannot help me in this situation.

My salary for 4 months= 1 lac 60 thousand. And the trauma and that I had to bear in repaying the loan I took form friends to cover the charges.

In the event, I also volunteered for donating my blood to a very needy person and told the hospital I was O+ve believing my report from MOOlchand.

Kindly advice, How should I proceed to file my complaint?

    Default Consulted Doctor

I have consulted a doctor and he says, that there has been medical negligence and it is not right to transfuse O+ve to a patient when his blood group is B+ve which is a very common blood group.

    I have a dual case:-

    1. There pathological tests were wrong on my blood samples. What if I suffer from something in the near future, is it only after I undergo some severe illness that the law will believe the term 'medical negligence'. I paid 1 lakh from my pocket not to get a wrong blood report and wrong blood transfused.
    2. When my blood tested negative for alcohol or any sedatives, how can they mention the same in my admission report and when I approached them to clear it, they simply denied saying it is hospital policy and they cannot change anything. I was denied insurance on that very ground.

Delayed and Long Term Adverse Effects of Transfusion

    Delayed Haemolysis
Cause: Patients may develop antibodies to red cell antigens. Antibodies can occur naturally, or may arise as a consequence of previous transfusion or pregnancy. A delayed haemolytic reaction occurs when a patient develops an antibody directed against an antigen on transfused red cells. The antibody may cause shortened red cell survival, with clinical features of fever, jaundice and lower than expected haemoglobin following transfusion. Most delayed haemolytic reactions produce few symptoms and may go unrecognised, however there are reports of serious consequences in critically ill patients.

Prevention: An antibody screen is performed as part of pre-transfusion testing. When an antibody is detected, it is identified and appropriate antigen negative blood is provided. Sometimes antibodies fall below detectable limits and may not be detected by pretransfusion testing.
