O R D E R

The Delhi Medical Council examined a complaint of Shri Dhan Singh r/o. D-1/224, New Kondli, Delhi – 110096, alleging medical negligence on the part of Dr. Rajat Anand of Metro Multispeciality Hospital, L-94, Sector-11, Noida – 201301, UP, in the treatment administered to complainant’s son Master Himanshu Shahi at Metro Hospital (I.P.D. No. 11038).

Shri Dhan Singh did not participate in the proceeding in spite of notice.

In the interest of justice, the Council decided to determine the matter on merits.

The Council perused the complaint, written statement of Dr. Rajat Anand, medical records of Metro Hospital and other documents on record. The following were heard in person :-
1. Dr. Rajat Anand Metro Hospital
2. Dr. Rajiv Ophthalmologist, Metro Hospital

It is noted that the patient namely Master Himanshu, a 9 yrs old male, with a diagnosis of right corneoscleral perforation with total hyphema was admitted in Metro Hospital on 18.6.2007. He underwent corneoscleral perforation repair with anterior chamber wash under GA with guarded prognosis on 19.6.2007. He was discharged on 22.6.2007 under cover of antibiotics/medication with a direction to review next day in the OPD or to report immediately in case of medical emergency and was advised to consult a cornea specialist for opinion.

It is further noted that the surgery was deferred in consultation with a paediatrician, because, as per the records, the patient was suffering from high fever. The patient was operated upon under high risk consent and the poor prognosis was explained to the complainant.

In view of the above, it is the decision of the Council that the line of treatment administered to the patient in this case was in accordance with accepted professional practices in such cases and no medical negligence can be attributed on the part of Dr. Rajat Anand.

Complaint stands disposed.
