On 28th October, 2009 Mr.Ramesh Manek Dedhia father of Dr. Chhaya R Dedhia a General Practioner underwent a Cataract surgery with Dr Hitesh Chheda at Asian Eye Institute & Laser Centre. The Doctor conducted the Surgery without any pre-operative investigations inspite of knowing the fact that Mr.Dedhia is a known case of IHD (By-Pass Surgery). The Cataract Surgery cost Rs.22000/- and was to be made through Medical Claim from DHS. The surgery was conducted and the doctor handed over the Empty Box of the POSTERIOR CHAMBER LENS which was implanted in the surgery to Dr.Chhaya Dedhia and then Mr .Dedhia was called for a check-up on the next day at 4pm and prescribed Antibiotic medicines and eye drops to be used for the next 7 days. On going through the box it was found that the POSTERIOR CHAMBER LENS had an expiry date of August’ 2009.
In a surprised state Dr.Chhaya called up Dr. Hitesh Chheda and was given a reply that even tough it has expired it would not be harmful and we can also go for a re-surgery. When consultations were taken from other doctors it was found that the surgery had caused infection to the eye and hence the Eye drops were given by the doctor. Also in the future Mr.Dedhia can also loose Eye Sight. A Re-surgery should be conducted only after 40 days from the surgery, whereas Dr. Hitesh Chheda did not disclose this and was willing for a re-surgery immediately.
Even after making repetitive calls Dr.Hitesh Chheda refused to diagnose Mr.Ramesh Dedhia inspite of the fact that he was having pain in the eye.
Now Mr Ramesh Dedhia has to wait for 40 days for a re- surgery and also hope that he does not loose his eye sight in 40 days.
The case above is a Purposeful Negligence act done by the Doctor which only doesn’t affect the health of the patient and is also a breach of trust.

The relief is quite fast.

The relief is not so quick as you think since my father's case is still pending in the Mumbai court since 2000.
