    Default Whirlpool fridge

    Hello sir,
    I am Alok Badwaik from Nagpur. We purchased Whirlpool Fusion model on 28/01/09. It has e-light feature and the problem is it is not working at all right from the purchase date. We contacted the service centre twice and both the times their mechanic came and told us that the PCB of e-light is damaged and needs to be replaced and asked us to wait for 2 3 days but uptil now they haven't replaced it yet.
    Infact one of them told us that he don't have the required skills to repair that part as it's the latest model and company is yet to give training on that model and without doing that they launched it in the morket.

    Dear sir/Madam,



    MY refrigerator is not getting cool from 13/04/09 and i have registered complain on
    14/04/09 the same is in the warranty of 1+4 years ( total 5 years warranty on
    compressor) whirl pool send an engineer to check the same and found compressor is
    got damaged now they are asking 750 Rs for rectifying the same pl. help me to
    rectify the same at free of cost and details are below.

    Default Whirlpholl Fridge

    One Whirlphool fridge model no 8091 was purchased on 30/7/5 from M/s SUR SANGEET, p-343, C I T Road, Kolkata 54 for Rs 15,800/-. Extended warranty taken by paying Rs 2170/- to M/s PENGUIN REFRIGERATION SERVICE, authorised Whirlpool service partner p-30, A & B, New C I T Road, Kolkata 700014 on 03 08 05 upto 31/7/2012.

    Fridge not cooling. Complain lodged, service rep came on 27/8/9, took the fridge and returned without rectifying the problem.The fridge is now almost dead and not at all working. Earlier it was working little bit. But after coming back from service centre it is complete dead and not working. What is the point in returning back the dead fridge to me. Now telling can not be corrected, we have to buy new fridge after paying 50 % price, can take back warranty amount of Rs 2,170/- or cover the new fridge to be purchased. Talked to Mr Viki, Service in charge and Mr Amit Ghosh on 08/09/09, who promised to call me back with detailed information. But no call or informations recd. Tried severally to contact on phone 033 22829696 but could not. Suffering unnecessarily without fridge for no fault of mine. Why no responsibility when extended warranty was taken. Pl advice what to do.

    O R D E R







    1.The case of the complainant is briefly as follows:

    The complainant had purchased Whirlpool Fridge from the 2nd opposite party who is the dealer of the Ist opposite party on 14.01.2007 for a sum of Rs. 18,290/- the fridge was delivered on the same day. Right from the date of purchase the fridge had cooling effect problem and the complainant had contacted the 2nd opposite party and informed the above defect. The service personnel of the Ist opposite party came to the residence of the complainant on 24.01.2007 and rectified the problem. Again the same problem arose and ultimately the defective fridge was replaced by another fridge on 28.01.2008. The replaced fridge had similar problem and again another fridge was replaced on 04.02.2008. The fridge now provided did not have tray, alaram and cosmetics stand.


    The iceberg model had manufacturing defect. Hence the complainant issued a notice to the opposite parties requesting them to replace the iceberg model with another model and pay a compensation of Rs.25,000/-towards damages. Though there is one year comprehensive warranty period for the fridge, the opposite parties did not acted on the notice of the complainant. Hence he filed this complaint for replacing the old fridge with a new one and direction to the opposite parties to take back of the refrigerator and to refund the value of fridge with 24% interest, Compensation of Rs.1,00,000/- for mental agony and cost of the complaint.

    2. The Ist opposite party filed version and contended inter alia that the technicians were deputed to inspect the fridge and after inspection they found that the appliance was working except few problems which will not affect the overall performance of the appliance and as a goodwill gesture the appliance was replaced with a new one. The instrument was delivered with all accessories attached thereto to the complainant. The complainant has not endorsed in the delivery chalan, regarding non delivery of accessories The appliance had no manufacturing defect. The complainant has not filed any expert opinion to the effect that there is a manufacturing defect in the fridge. There is no deficiency in service on the part of the Ist opposite party.

    3. The 2nd opposite party received the notice did not appear before this forum. Hence he was set ex parte.

    3. Proof Affidavits have been filed by both the complainant and the Ist opposite party. Exs.A1 to A8 were marked on the side of the complainant. No documents were marked on the side of the Ist opposite party.

    4. The points that arose for considerations are:

    1. Whether there is any deficiency in service on the part of the opposite party?

    2. To what relief the complainant is entitled to?

    5. Point No:1

    The complainant had purchased Whirlpool fridge from the opposite party on 14.01.2007 for a sale consideration of Rs.18,290/-. According to the complainant, right from the date of purchase of the refrigerator, had cooling effect problem and he had contacted the 2nd opposite party but he was advised to contact the Ist opposite party. The service personnel from the Ist opposite party came to his residence on 24.1.2007 and rectified the problem. Ex.A2 is the bill for purchase of the refrigerator. Ex.A2 is the service request form they did not contain any defects . Ex.A3 is the appliance replacement advice issued by the Ist opposite party. Ex.A4 is also another appliance replacement advice issued by the Ist opposite party dated 4.2.2008. The complainant issued notice on 14.2.2008 to the opposite party stating that the fridge had mechanical problem.

    Per contra the opposite party would submit that the complainant failed to establish that the appliance presently under his custody, having many defects and seeking relief. But the replacement was made by the Ist opposite party on 26.6.2008 and after that the complainant not made any complaint regarding its defects. Even in the delivery chalan he has not stated that he had not received the accessories along with the refrigerator. The defective product is not sent to the laboratory test and for expert opinion. Hence there is no deficiency in service on the part of the opposite parties.

    We have carefully considered rival submission and perused the material on records, It is true that the refrigerator was replaced on two occasions and the present refrigerator was replaced on 26.2.2008. Ex.A8 is the appliance replacement advice. The present refrigerator was replaced after filing of this complaint. But the complainant would submit that the defects still exist. But and the complainant has filed any expert report to the manufacturing defect.


    In absence of any expert opinion regarding manufacturing defect, we are unable to accept the contention of the complaint that the fridge supplied on 26.2.2008 suffers manufacturing defect. The complainant not ever made a complaint about its manufacturing after 26.2.2008. On consideration of evidence by both parties. We are unable accept the contention of the complainant that there is deficiency in service on the part of the opposite parties. We hold that there is no deficiency in service on the part of the opposite parties.

    6. Point NO:2

    In the result, the complaint deserves no merit and is liable to be dismissed. Accordingly the complaint is dismissed. No costs.
