Dear Sir,

I have booked 2stroke CNG auto rickshaw with token amount of Rs.30,000/- on
26.12.07, only on that basis that dealer will be delivery CNG Auto rickshaw on or
before 03.01.08 means after 1 week, as per condition of quotation i have to deposit
balance amount of Rs. 89500/- on delivery date 03.01.08, if as a customer i will be
failure to deposit 89,500/- they will be charged 15% interest on delay payment.
Therefore I have arrange 89,500/- from market at @ 2% to pay deler on 03.01.08.

But dealer failure to make delivery on 03.01.08 I repeatedly daily touch with
dealer.On 11.01.08 he told me that to day 8 nos of 4stroke CNG Auto rickshaw
delivery has been done but you have order for 2 stroke. when I visited show room on
12.01.08 and inquiry about delivery I was shock there is not single delivery has
been done on 11.01.08.There after I complain about dealer to regional manager Bajaj
Auto Ltd at Ahmedabad but I am not getting any single response from dealer as well
as Regional Manager bajaj co . Ahmedabad

The dealer has make 12 times promise to make delivery but he always failure to make
delivery and he passed 2 and ½ months I repeatedly request them if they are unable
to make delivery then arrange from others dealer but they can't at last I tired and
cancelled order to buy CNG Auto rickshaw from this dealer and request for refund.

They are ready to refund within 2 days but they are also failure to make refund in
time I have Nos. of time make fax about refund in last they have refund after 20
days of my token amount of Rs. 30,000/-

After getting refund of 30,000/- I have claim 30.963 to dealer due to defected
(poor)service but he is not agree to pay any compensation for defective (poor)
service I have nos. of time make fax for claim as well as given legal notice
also…but they are not given any single replay for that

WHAT SHOULD I DO…?

SHOULD I HAVE TO GO CONSUMER COURT ….?

BEFORE GOING TO CONSUMER COURT ….I HAVE SOME QUESTION RAISED AS UNDER

PLEASE CHECK IT AND GIVE ME YOUR KIND OPINION

My questioned is as below

1, Can I get interest on 30,000/- from date of deposit to refund of deposit for 64
days…..?


2. Can I get interest on 89,500/- from delivery date 03.01.08 to 07.03.08 (refund
date) Which has been I borrowed to make payment on 03.01.08 ?

3 . Can I claim per day RS. 400/- Business loss from delivery date to 03.01.08 to

refund Date 07.03.08 for 64 day’s because they are failure to make delivery
from
03.01.08 to Till refund date 07.03.08

4. Can I entitled to compensation for distress, upset, disappointment and
inconvenience

I have proof as below

1. I have receipt of 30,000/- which has been paid as deposit on 26.12.07 with
chq.. And they have encase on 27.12.08. as bank statement

2. I have e-mail copy to make complain regional manager regarding his
authorized
Dealer has chatting with us.

3. I have proof of 89,500/- to cash deposit in my bank account to pay them
on
03.01.08 as bank statement

3. I have FAX COPY of they have not refund in time

4. I have Quotation copy where mentioned that customer have to pay 15% interest
on delay payment if not paid on delivery date ( but I have arrange before date
89,500)

I haveNot proof as below

1. Dealer has not given in writing to give delivery on 03.01.08 only verbally
committed.
2. I have borrowed an amount of 89,500 @ 2% from market from various persons
but no body has given in writing that I have taken loan ( but I can show
bank
statement that before delivery I have cash deposit 89,500/- in my bank A/c)

Please give me your opinion and help me what to do…?
