    O R D E R

    1. The Complainant states that he has booked one car Peugeot 309 on 30.10.1995 with Opposite Party No.1 through its Dealer Opposite Party No.3 for a total consideration of Rs.6,32,268/-.


    2. The Complainant states that he has deposited Rs.25,000/- at the time of booking the said car against priority no.18022.


    3. The Complainant further states that he had filled up Form No.0197293 giving detailed information therein.


    4. It is stated by the Complainant that the vehicle had not been delivered as there was a delay for delivery of Peugeot car in stipulated period. Thereafter he received a letter dated 15.12.97 from the Opposite Party No.3 with an intimation priority is likely to mature for delivery indicated for Peugeot car.

    5. The Complainant states that as he was not interested in delivery of car on 13.09.97 he wrote a letter to Opposite Party No.1 at earlier address and requested to refund the demand draft amount alongwith interest through local dealer, Opposite Party No.3. Thereafter he sent two reminders dated 6.3.1998 and 26.3.98 to refund the amount with a copy to Opposite Party No.3.


    6. The Complainant states that he has returned the original receipt cum priority card which has been received by Opposite Party No.1 with intimation to Opposite Party No.3.


    7. The Complainant therefore prays for the following:

    (a) To direct the Opposite Parties to refund the d.d. amount of Rs.25,000/- along with Bank interest with effect from 30.10.1995 till the payment is done by the Opposite Parties and compensation of Rs.20,000/- for delay, harassment and mental torture.


    The matter was ordered to proceed exparte against Opposite Parties as per Roznama dated 16/03/09 as Opposite Parties failed to participate in the proceedings. Complainant has filed Affidavit in evidence and documents has proved his case beyond reasonable doubt.


    ORDER

    (1) The complaint is upheld. Opposite Parties are directed to refund the D.D. amount of Rs.25,000/- along with interest @ 12% with effect from 30.10.1995 till the payment is done by the Opposite Parties.

    (2) Opposite Parties to pay compensation of Rs.5,000/- for delay, harassment and mental torture.

    I, Sudhir Gupta had booked PAL BEUGEOT 309 VIA FORM SR. NO. 41115, CONTROL NO. 98294, DEALER PRIORTY REGN NO. D-210 / 4825, DEALER NAME : VIVEK AUTOMOBILE LTD. DELHI, RECEIPT NO. 70081.

    SINCE THE CAR WAS NOT LIKELY TO BE DELIVERED IN TIME, AFTER THAT I HAVE CANCELLED MY BOOKING DT. 24.09.96 BUT NOT RECEIVED MY BOOKING REFUND TILL DATE. I HAVE SEND 2-3 REMINDER FOR THE SAME AND AFTER THAT I HAD FILED CASE IN CONSUMER DISPUTES REDRESSAL FOROUM II, GOVT OF DELHI UDYOG SANDAN, INDL AREA, NEW DELHI. THEN COURT DO THE FAVOUR THAT REFUND THE BOOKING AMOUNT WITH 24 P.A. INTEREST. IN THIS CASE 62 ORDER PASSED BY THE HONABLE COURT. ( THAT M/S PAL PEUGEOT LTD ARE ALSO DIRECTED TO PAY A SUM OF RS. 2500 TO EACH COMPLAINT AS COMPENSATIONFOR THE MENTAL HARASMENT CAUSED TOTHEM AS ALSO ANOTHER SUM OF RS. 1000 TO EEACH COMPLAINANT AS COST FOR PURSUING THESES COMPLAINTS. THE WHOLE AMOUNT SHOULD BE PAID WITHING TWO MONTHS FROM THE DATE OF RECEIPT OF A COPY OF THIS ORDER BY O.P. IF THIS ORDER IS NOT COMPLIED WITH WITHING THE SAID PERIOD, THE WHOLE OF THE AMOUNT CALCULATED UP TO DATE OF PASSING OF THIS ORDER SHALL TETCH INTEREST @ 24 % FROM THE DATE OF THIS ORDER TILL PAYMENT.

    THEREFORE PLEASE REFUND MY BOOKING AMOUNT AS PER COURT ORDER TILL DATE OTHER WISE I WILL AGAIN FILED THE CASE IN CONSOURUM COUR WITHIN 15 DAYS.

    I understand that your land has been sold for 603 crores, would request if you could refund back my money.

    I have been woring in tis company from July 96 as an Electrical Officer in plant engineering department. The last salary I recieved from the company was in May 98. After that the company stopped paying salary nor relieved me from my job. After 2 years i got a job opportunity and moved on.

    Now PAL - PEUGEOT land has been sold for 601 crores. Out of which the Union has got 125 crores as dues to be paid to workers from june 98 to sept 05.

    What about me. As I was in management I can't collect my dues from the Labour Union office.

    That means thousands of officers from the plant will be left high and dry.

    I want my dues. It is my hard earned money. Living a life for 2 years without a salary is not easy. which Mr. Doshi and Mr. Vakil will not realize.

    Now I think we are in the mercy of these management people to give us some share of these crores they have earned.

    We are a part of you.
