    Default Club Mahindra is becoming a real fraud now

    I have been a member of Club Mahindra since 2001 and as opposed to most of the posts on this blog, I have been very satisfied with their services till recently. However, now that is changing very fast. It appears that the company has grown too big and is trying to bully the members, taking them for granted. I shall give a few examples.

    1. I have a membership for 1BR in white season. Earlier, whenever I wished to book, Club would accept the booking if space was available, in any season and in case I was booking for a Red season, they would charge me 1.4 nights for every night that I used. This was perfect and I do not think any thing wrong here. Now, if I try to book in a Red season, they will accept booking only 15 days prior to the vacation. By that time, all the space would be booked and there is no way I can avail of a booking in Red season. Well, I took the membership (and am sure, many others too) knowing fully well that it will not be possible for me to go on a vacation every year and I could take a vacation in a higher season by accumulating weeks. That was the promise held out at the time of taking the membership too. This sudden change of rules means that I cannot take a holiday ever in Red season. In a way, Club Mahindra is forcing its members to upgrade their membership to higher season. This is patently illegal, against the agreement that was entered into at the time of membership which cannot be changed by one party to the agreement alone. This time they accepted my booking after a lot of argument, but that left a sour taste in the mouth - the Club is not obliging me by accepting my request for booking - I have paid for the membership and am entitled to the vacations. May be I shall take a legal action against the Club on this issue.

    2. Similarly, earlier if I wished to book space in Red season for even one night, that was done. Now, they insist on booking a minimum of three nights. Again this one sided change is outright illegal. I think I shall take up the issue in appropriate consumer court.

    I request you to please help me in preparing a plaint and filing a case in appropriate consumer court. I am presently living in Bangalore, and had taken up the membership while I was living in Kolkata in 2001.

    Thanks for your reply to my posting on consumercourt.in.

    I have been a member since 2001, and have enjoyed my holidays at Club Mahindra quite a lot. My first vacation was at Munnar followed by Goa in the same trip, and both being Gold Crown properties, me and my family still cherish the experience. I have strongly recommended my friends to go for membership and once or twice have given them my weeks to go and experience first hand the facilities that you have. In nutshell, I have been a very satisfied member.

    All this changed recently when I called your call center to make a booking for my daughter. I was told that being a White Season member, I could book in Red season not earlier than 15 days of the planned holiday. Please tell me do you really expect to get a vacant slot in Red season within 15 days at a property like Munnar ? Is that not going to be very rare ? In a way, you are denying me the facility of using the vacation in a higher season even if I am ready to use extra days in accordance with your norms. Further, who is Club Mahindra to unilaterally change the agreement that was entered into between me and Club Mahindra ? That this clause was not there in the agreement is apparent from the fact that never before has Club Mahindra asked me to book in a higher season within 15 days only - most of my bookings have been in higher season and much in advance.

    Lately, whenever I have visited any property, I am requested to upgrade my membership to a higher season, which I have always resisted. I know that I can never use all the weeks that accrue to me, and therefore I can easily afford to give extra days whenever I want to take a vacation in a higher season. Now, with the new rules of booking, you are compelling me to change my membership to a higher season. Well, I am not allowing you to do that.

    Further, this time, I was told that the booking in a higher season can be for a minimum of three nights. Again, this is a new rule - you can check my own booking history to verify that earlier Club Mahindra has allowed me booking for two nights in higher season. Once again, who is Club Mahindra to change unilaterally the agreement between two parties without the consent of the other party ?

    In case you actually want to sort out this issue, it is my request to please forthwith abandon these new rules. If that is not done, you are sure to face a lot of litigation, from me, and I am sure, from many other members who would certainly feel the same way. All the goodwill that you have earned over last decade or so will evaporate overnight. This is not a mistake or promise by some executive - these are decisions at corporate level that the senior management has to look into - I do not know how far you will be able to take the issue. Therefore, I just say - God help Club Mahindra.
