Following is the description of my problem.

I have a savings account in State Bank of India, Kururkshetra. Currently, I am
working in Noida. Around one and a half month back, I had planned to invest my money
in an FD. So, normally, I make all my invetsments in my native, i.e. Kurukshetra.
Similar to earlier cases. this time also, I gave my ATM card to my dad for
withdrawing the money and investing it in FD for which I had already given the
filled form.

Earlier in SBI, there was a restriction that we could withdraw only 15000 from ATM
machine in one day. In between sometime it was revised to around 40K to 50K. Not
very sure about it. But, we were still unaware of it. So, my father used to withdraw
15000 everyday for my FD from my account from the ATM machine. Around 3rd or 4th day
when he went to withdraw, he swapped the card as usual and tried to withdraw. But,
there was some problem in machine. An another person was trying to withdraw but he
could not. Then, my father also tried but even he could not. Then again the other
person tried withdrawl. This time, he could withdraw successfully. Then thinking
that the machine is fine, even my father tried again but second time also he could
not withdraw. The receipt was also not coming from the ATM machine that day which is
very normal in ATMs. So, second time also when he could not withdraw, he went to an
another State bank of Patia ATM which was just 5 minutes distace from there.
He withdraw Rs. 15000 from there. On checking the balance on slip he found that
20000 were already deducted from my account. He verified everything again and went
to the bank immediately. After checking, the bank officials said that 20000 have
been withdrawn by us from the ATM machine where he went earlier and which was not
working.

My father told them everything about what all had happened and that he had tried a
withdrawl of 15000 and not 20000 and that there was some technical fault in the ATM
machine and he could not withdraw. He kept standing there for quite some time.

But, the bank officials did not take any action at that time. First they said that
they require the complaint be initiated by the account holder. Then when I came to
know this, I faxed my complaint from Noida.AFter that again in the afternoon my
father went but they said it'll take time. He kept on going to bank daily. After 2-3
days, they said no need to come daily and they'll call up on there own.

After few days, they said that from the statements a transaction of 20000 have been
completed successfully by us. And they just said that next time when you go to ATM,
make sure that no one enters the ATm till we complete our transaction.

Now, my points are as follows:
1) My father tried a withdrawl of 15000, then how could 20000 be deducted from my
account.
2) When we tried the withdrawl, we could not. My father kept waiting for some time.
but nothing happened at that time. That means, there was some problem in the machine
which they did'nt agree.
3) There was no video camera installed in the ATM nor was there any appointed guard
outside the ATM. If there would have been any camera or guard then we would have
atleast got a proof of what all happened.
4) Bank says that for this case, we should not allow anyone inside the ATM unless we
complete or transaction. But, the point is that this is not controlled by the
public. This should be controlled by the security guard appointed by the bank. We
cannot keep on fighting out side the ATM with people for not entering inside.
Otherwise, our turn will never come.Becasue in that ATM always 3-4 people will
definitely be inside the ATM. so, why is there no guard outside the ATM.
5) The ATM machine that I am referring is installed inside the SBI bank. My father
had reported our loss of 20000 rs within 15 minutes when the problem occurred. The
bank officials did not take any action at that time. Now after these many days, in
the feedback to my complaint, they dont agree that there was any fault in the
machine.
6) We told them that person who had withdrawn after us had withdrawn a considerable
amount of money. Because there were many notes in his hand. So, may be due to the
problem his transaction might have been performed from my ATM card. Because
definitely something wrong had happened. But, my father remembers that that fellow
had swapped his card. So if this was the case then even though he swapped his card,
his amount might have been deducted from my account. We told the officicals many
time to check the people who had done transactions and swapped cards before us and
after us. But, they say that they cannot question there customers.



The concluson for all this is that without my fault and due to the negligence of
bank officials(that too reputed bank like State Bank of India), the bank have robbed
me of 20000 rs which is not a small amount. For all this, I want to file a complaint
in consumer court against the bank and that my money should be refunded.
