I, the undersigned, Kishore Atmaram Mistry, do hereby submit the facts in brief as below for your kind consideration and providing justice against above said Opposite Party / Company: (Matter has been referred to Consumer Guidence Soceity of India, Mumbai by Mail & by sending documents)

This company has given Ad in local Marathi newspaper Maharashtra Times Wednesday, dated 03-04-2013 in Times Classified saying “Loans in 15 minutes verification, in 6 hours loan, no commission 3% (55% rebate) annual all types of loans contact-09582336192/08447945451/08742976349” (Annexure I) which has misled me and caused loss of Rs.16,001/- by a way of cash payment deposit in expectation of Personal Loan of Rs.2,00,000/- needed badly for meeting immediate requirement of SBI payment due date of 25.04.2013. Following are the sequences of happenings:

03-04-2013 - On contacting on Mob. 09582336192 one Ms. Sneha sent SMS from mobile no. 08447945451 giving e-mail id hindustanmoneysolution@gmail.com & fax no. 07838593977 and asked for sending scanned document copies of Ration Card, Election Card, ICICI Bank Statement from 04-12-2012 to 03-04-2013, 2 Scanned Photos, Salary Slips of Dec-12 & Jan-13, Leave & Licence Agreement of present stay for availing Rs.2L loan amount, which I sent (Annexure II - email). From the same Mob. She again sent SMS giving SBI A/c. No. 30874210090 of Bind Mishra for depositing Rs. 2000/- as processing fee and asked me to send scan of the SBI Counterfoil for the said payment. (Annexure III)
05-04-2013 – They sent Sanction Letter bearing Application No. PL015H12013 dt. 05-04-2013 via email id hindustanmoneysolution@gmail.com giving 10 days validity (Annexure IV) and asked me to pay 3 months EMI in advance (2 Rs.4667/- per month) which amounted to Rs.14001/- which in expectation of urgent loan I paid on 12-04-2013 in SBI A/c No. 32472720309 of Avanish Singh (Annexure V) which details she has sent via SMS from the said Mobile.
15-04-2013 – from 'rubina jack' from same email id Solvency format was sent (Annexure VI) and asked me to execute it on Rs.100/- stamp paper which I typed on Non-Judicial Stamp paper but wasted as ICICI bank refused to give it. In lieu of it I asked bank to give certificate specifying A/c. No., type of a/c., period of operation, and balance in a/c as on 16-04-2013 (Annexure VII). Which Hindustan Money Solution did not accept.

16-04-2013 - When talked about inability of the bank to provide solvency certificate on Rs.100 stamp paper and only certificate on ICICI bank Letter was given she said that will not help & no loan can be given. She also doubted about my credibility for not giving the Solvency Certificate by the said bank. When asked for giving back my amount sent to them she asked to write mail for refund which I deed same day but the company did not respond to phone or email. (Annexure II - email)

18-04-2013 – I again sent email asking for refund and tried to talk to her but no one was responding and line went on busy.

With great difficulty I could talk to the lady who said you talk to Krishna ma’m who talks to you about this she is not there when comes back talk to her. And as you have not completed the formality i.e. not provided solvency certificate we can’t give you loan and your amount will be refunded only after 3 months. That’s now became a policy of the company.

These people (mostly ladies) are only providing names & SBI A/c Nos. and Format. They do not mention even a line in the mail, means not committing anything in writing – everything verbal on mobile no. given above.

I am worried about my payment to SBI to whom I had given cheque dated 25.04.2013 of Rs.1,00,000/- as no loan has been materialized from this Hindustan Money Solution apprehending the action by SBI as there is no money with me to keep in A/c. for passing this cheque.

May I request for providing me justice for –

1. Returning the amount of Payment of Rs.16,0001/- paid by me,
2. Providing compensation of Rs.2,00,000/- for not providing PL at all thereby causing undue mental agony to meet deadline of payment to SBI on 25.04.2013
3. Any other compensation you feel just and reasonable.
