    Default Club Mahindra holidays - Cancellation of membership and reimbursement of down payment

    Hello Sir/Madam,

    My husband (Mr. P. N. Ayappa) and I (Vimala Ayappa) requested cancellation of Club Mahindra Holidays and reimburse our down payment of Rs 27,500 for the following reasons for cancellation:
    The club Mahindra agent came home and provided an overview of the membership following which we enrolled on the same day with a down payment of Rs 27,500. We were told the facilities can be availed after the third EMI. Later, an official informed us that it can be availed only after one year.
    The gift vouchers do not allow us to avail the facilities in the red season. We were told that white season membership provides us flexibility to use both red and white seasons. That advantage is not there for gift vouchers was not told to us.
    When we explained all these issues to your official we were told that everything is written in the documents and we should have read it before enrolling for the membership. We have invested extensively on bonds, insurances etc., and we trusted the agents who explained the features. We did not find discrepancies in the agent’s words and documents. We did the same for Club Mahindra, but there were lot of discrepancies in what was told and what is documented.

    We are extremely disappointed and feel let down and cheated after this.

    We do not want to continue with this membership and request you to reimburse the amount and cause less pain and trauma for a decision that went totally wrong.

    The request for refund has been rejected.

    Please help us get back out money.

    This is sheer injustice considering that I have not utilized any benefits from Club Mahindra Holidays. Hence I was forced to go to the consumer court.


    Please help me get back my down payment. The details of the down payment are attached.

    Default Club Mahindra Membership Cancellation

    I applied for Club Mahindra Membership on 23rd oct. Actually I asked the sales person to allow me some time to think over the membership plan and revert back, but he said that anyway if you want, you can cancel within 10 days and get full refund. I applied for cancellation after 3 days and despite multiple emails and reminders, I have not got my refund nor any status update. Further, even after cancellation, I received the membership document and payment schedule on yesterday.
    I don't know why the customer service levels are so pathetic at Club Mahindra. I want to know about the status of my membership cancellation and expected time for refund.
    My membership no. is 2379170.

    This is to inform you that the meeting that you mentioned above did take place on 13th November and I am given to understand that the refund process will begin by providing a form where the account details need to be provided.

    Can I expect that to happen soon?

    Sandip's mail does not address any of my concerns. It is a repeatation of the refusal to refund downpayment which triggered me to approach the consumer court. Please find the contents of his mail:

    Dear Mrs. Vimala Ayappa

    Greetings from Club Mahindra Holidays!

    With reference to your discussion with Mr.Srinivas and Mr.Rakesh we would like to inform you that, we have raised the cancellation request and your future payments are on hold.

    However We draw your attention to the membership rules, Clause no 6.1 (a) about cancellation of the membership.

    Cancellation Policy:
    6.1 (a) Withdrawal of application for CMHM shall be permitted within the Rescission Period which is 10 days from the date of realization of 25% of Admission Fee, provided such request for withdrawal is made in writing and signed (by both the Applicants/Members in case of Joint Membership) and reaches MHRIL within 10 days from the date of realization. In the event of such withdrawal, MHRIL shall refund the entire amount received from the Member towards Membership Fee within 30 days from the date of receipt of request for withdrawal. In the case of joint applications, refund shall be made to the first applicant only.

    In the event of withdrawal of the application by an Applicant beyond 10 days from the date of realization, the Applicant shall not be eligible for any refund of the amount of the AF paid by him.

    Since there is no refund of the amount paid by you so far, we urge you to reconsider your cancellation request and continue to enjoy holidays with Club Mahindra.

    On our part, we will strive to regain the trust you had placed in us and we look forward to giving you many years of memorable holidays.

    Thank you very much again for giving us the opportunity to be of service to you.

    Respected sir,

    I undersigned Vidya Jagdish Shelke request you cancel my membership with Club Mahendra Holidays Jiyo Life through Application from no ( Oct - 11 4751) against which my husband has paid on my behalf an amount of Rs. 27,500/- through ICICI Debit card (invoice no - 001163) 0n 17/11/2011.



    in view of the abouve . Kindly refund the full amount as soon as possible.

    The mail that Mr Sandip Banik sent has been discussed extensivley in my reply dated 11-16-2011. No progress has been made ever since.

    Default REQUEST FOR REFUND OF Rs. 27,500/-

    Respected Sir/ Madam,
    This is regarding my REQUEST FOR REFUND which has been sent several times in my earlier mails ( dated 15,16,21,23 & 25th of Nov. 2011) to feedback@clubmahindra.com but No Positive Response so far. The whole incident is as follow:-

    1.REQUEST FOR CANCELLATION was given on the same day evening (18-09-2011) when membership was taken, over the phone to Mr. Alekh (executive at DT Mega mall) as after reconsidering our budget we found it was not in our budget.
    2.
    We were informed that executive personally would visit us for the same.
    3.
    It was not informed even a single time that cancellation needs to be done within 10 days (according to clause 6.1). When we were informed about all other good features about membership in same way they should have informed us about cancellation clause.
    4.Purposefully they kept on delaying by making several calls (from different executive of DT Mega Mall) and telling different stories.
    5.
    Finally we had to visit as nobody turned up for visit. There Alekh misguided us saying that as this membership is under Promotional offer so it can neither be cancelled nor be refunded.
    6.Even he suggested us the way to avail International Trip FIRST after paying ONLY 3 EMIs and Then discontinue paying EMI which will automatically make us canceling the membership.
    7.
    After going through your welcome mail we came to know about the fact that information given by Alekh is totally wrong.
    8.Even writing to you and having conversation with Ravi Shankar Neogi (Member Relations Department) is disappointing as after hearing whole incident over the phone again after 2 days he sent the same standard mail which was sent before telephonic conversation. No action was taken from his side after phone call (For reference conversation so far on email is attached on my email dated 25th Nov. 2011).
    9.Ravi clearly asked me to talk to Alekh as he can not do anything in this regard. 10.

    It is really not expected from such a big brand like Club Mahindra.
    I expect this to be resolved at the earliest. It is really traumatic experience with Club Mahindra.

    Please help us to get back money of ` 27500. It is our hard earn money.
