Dear Sir,

I the undersigned Mr.Ajay Kumar Gupta humbly bring to your kind notice that I had purchased a 1.5 Ton Magicool Air conditioner Model No.150 EL bearing serial number:-INJ 051706372 on date 25.07.2005 from M/S Kirti Freeze (Deesa) vide Invoice No.-100 dated 25.07.2005. I had purchased the Air conditioner of your company after comparing the results of the Air conditioners of other companies. I am employed as a Deputy Engineer in Uttar Gujarat Vij Company Limited (Formerly Gujarat Electricity Board) and posted now in Kalol on transfer from Deesa.

1. I had sent my first complaint about the overloading of the AC on 23.05.2006 to your Registered Office at Pune I.e. well with in warranty period but did not receive any reply. (The copy of the complaint is attached herewith.)

2. I had sent my second complaint to your Registered Office at Pune again on date 15.06.2006 i.e. again within warranty period. Again the company did not care to reply. (The copy of the complaint is attached herewith.)

3. During that, I tried to contact your various offices on phone as given in the manual, bur found the numbers changed.

4. On date 18.03.2008, I had sent a complaint to your office in Mohan Co-operative Industrial Estate, New Delhi. Instead I received Ahmedabad branch’s letter dated 23.08.2008 stating that the machine was outside warranty which I cannot understand because my first two complaints were within warranty.

5. I had agreed for the replacement piece after your helpdesk office had assured me that a fresh piece will be delivered to me.

6. The Ahmedabad branch sent the replacement piece on 16.07.2008 which was found to be defective as it had kinks on the cooling fins inside the back grill and it was full of dust and appeared old.

7. It is really shocking to inform you that since Dec-2007, I am without your copmpany’s air conditioner .The defective AC was collected in Dec-2007 by your Palanpur representatives (of Sai Refrigeration) for returning it to the company for replacement and the replacement piece being defective was not accepted by me on 16.07.2008.Since then the company has remained silent by keeping the old AC and not giving me the replacement AC as well. Also they have not cared to reply to my letter dated 23.09.2008.

It is kindly requested to look into the matter and refund the entire amount paid by me for purchasing the AC as with the passage of the time and your company’s apathetic attitude towards me, I have lost faith in your internationally reputed company for giving me the pains for supplying me a defective AC and cheating me in the process.
Hoping for an early positive response.

Encl:-As stated

Thanking you,

Sincerely yours,

(Ajay Kumar Gupta)
