Subject – Complain Against Gem Electronics for Non Delivery and Double Payment of Purchased Items

Dear Sir/Madam,
I had purchased 2 items from Gem Electronics in Dombivli on 14th May 2010.
Following are the Items Purchased:
1. AC Whirlpool 1.5 Split 3 Star
2. Fridge LG 308 VM

We made a payment through 2 Credit Cards
1. Payment towards the Fridge
Credit Card No. XXXXXXXXXXXX6000 RAK Bank Master Card Dubai
Item Cost Indian Rupees 19,000/-
The Amount Charged – 19,000/- Indian Rupees
2. Payment towards the AC
Credit Card No. XXXXXXXXXXXX1005 Dubai Bank Visa Card Dubai
Item Cost Indian Rupees 25,500/- + Indian Rupees 500/- for Credit Card Commission
The Amount Charged – 26,000/- Indian Rupees

Gem Electronics Requested us to swipe the card through their other shop named Mahavir Distributors.
We oblige and we swiped the card in person and the payment was through. We even got the confirmation receipt from the merchant.
However the Gem Electronics denied reflecting any payment in their bank account of the particular transactions.
Gem Electronics further started harassing for the payment saying they did not receive any payments from us.
Fed up with their constant harassment we went to their shop to complain the owner.
The owner Later suggested that we exchange the cheques of the possible disputed amount.
In good faith we agreed to do the same and exchanged the cheques

Till now they are not accepting that they received any money while we confirmed from our banks of the payment made through.
Later they also Deposited our cheque.
As of now we have just got the AC out of the 2 purchased items. They are not delivering the fridge saying they did not receive any funds in their IDBI bank account.
Till now we have made them payments through following :
1 Credit Card Swipe of Indian Rupees 19,000/-
2 Credit Card Swipe of Indian Rupees 26,000/-
3 Cheque of Indian Rupees 25,500/-
Total amount is 70,500/-
Out of which we just go AC worth Indian Rupees 26,250/-(As mentioned the receipt)
We kindly request you to guide us in getting our remaining money back with interest.
The money they own us is Indian Rupees 44,500/- Plus Indian Rupees 500/- = 45,000/- Plus Interest.
We kindly request you to take some action against these fraud merchants.
