    Default Complaint against naaptol

    Dear Sir,
    In the first half of May, 2010, I was lured by an advertisement that appeared in the Times of India by Naaptol, Mumbai and ordered online a mobile phone Boss3300. The product was delivered to me on 27/5/2010 on cash on delivery. From the very day of delivery, the phone's touch screen did not respond as expected and finally on 15/6/2010 when I was away to Guwahati on an official job, the touchscreen got hanged. As all my official contact numbers were all set in the phone, I had no option but to approach a mechanic to retrieve them who on the contrary told me that the phone's 'touch' became damaged and so thhe numbers could not be retrieved. Coming back to my place of work, I contacted Naaptol at two of their e-mail addresses as was supplied continuously for a week but finding no response, I contacted them on their phone number 09223516148. I was told by them that I have to pay additional Rs1200/- for rectifying the problem. I was dismayed and surprised to hear that because neither in the product details on their site or on the warranty card supplied to me along with the product, it was mentioned that the product does not enjoy any warranty of touch screen though the warranty of the product as a whole has been mentioned as six months. I feel cheated for the said reply as the product is well within the period of its warranty. The Order number of the product is 375522.
    I am convinced that the men at Naaptol is not going to honour the warranty as was promised and so I am planning to rectify the set on my own at my own cost, if possible. In fact they have suggested me to do so over phone. I am writing to you in order to know as to whether indian law provides for any remedy against such online shops. How an ordinary citizen would tackle such menaces? Please help. Awating eagerly for a solution.
