    Default against BSES for unfair treatment on account of dishonor

    Dear Friends,
    Recently I paid my electricity bill by cheque. Cheque got dishonoured because of indifferent signature. However, when I contacted Manager Bank of Baroda, Karampura Commerical Complex Branch on which cheque was drawn, it was found that it was the mistake of the Bank. Bank accepted its mistake and waved off Rs 100/- fine which they imposed for dishonoured cheque. Also they appologised for the mistake. However, when I approached the BSES office, they refused to listen to me and said that I have to pay Rs 200/- as fine to BSES( which is their standard fine irrespective of mistake is made either by consumer or by the bank). Not only that they have told me to make payment in cash only in future
    and my cheque will not be accepted. However, when I didn't paid fine stating that I am filing a case in consumer court and paid rest of my bill in cash excluding fine amount, BSES discontinued electricity supply to my house in my absence. Can anything be done to teach a lesson to BSES and Bank because of whom not only I faced humilation but also paid Rs 200/- as fine.

    i don't understand why you are blaming to BSES? If the cheque, issued by you, got bounced then what's the fault of BSES? BSES is not concerned with whose fault it was. Moreover when the cheque got bounced, BSES' banker must have also deducted some amount/ fine from its account. So why should BSES loose money, just bcoz of ur bank's fault?
    It's better u collect this BSES fine of Rs.200/- from ur banker.

    Hi!
    You paid BSES and your cheque bounced. Obviously, BSES has to ensure that this does not happen again, and hence they ask you to pay in cash (prevention better than cure!) Moreover, BSES's bank will fine them (BSES) for a bounced cheque - why should they pay for someone else's mistake?
    Is BSES unfair? IMO - not at all. Now the other side of the story, the goof-up that you bank did. Please remember the fact that they accepted their mistake - thats a sign of a good relationship! They could have denied their mistake as well – and nothing much could be done about it!!
    The best thing, I would suggest - is to insisit them for a letter where-in they apologize the mistake and
    assure BSES that such things would not happen again. Try presenting this letter to the BSES in-charge as a proof of your being not-at-fault. There is no question of teaching BSES a lesson per se, yes maybe you could ask them to be a little polite and upfront in their actions. As far as the bank is concerned, they have accepted their error, and all you need to do is tell them the problem u r facing, and they need to help u out!!
